]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1256 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO THE DEPARTMENT OF LABOR; AMENDING SECTION 72-1333, IDAHO CODE, TO 3 PROVIDE AN EXCEPTION FROM THE MERIT SYSTEM FOR EMPLOYEES OF THE IDAHO 4 CAREER INFORMATION SYSTEM; AND AMENDING CHAPTER 13, TITLE 72, IDAHO CODE, 5 BY THE ADDITION OF A NEW SECTION 72-1345A, IDAHO CODE, TO PROVIDE FOR THE 6 IDAHO CAREER INFORMATION SYSTEM WITHIN THE DEPARTMENT OF LABOR AND TO PRO- 7 VIDE FOR THE IDAHO CAREER INFORMATION SYSTEM ACCOUNT. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 72-1333, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 72-1333. DEPARTMENT OF LABOR -- AUTHORITY AND DUTIES OF THE DIRECTOR. (1) 12 The director shall administer the employment security law, chapter 13, title 13 72, Idaho Code, the minimum wage law, chapter 15, title 44, Idaho Code, the 14 provisions of chapter 6, title 45, Idaho Code, relating to claims for wages, 15 the provisions of section 44-1812, Idaho Code, relating to minimum medical and 16 health standards for paid firefighters, the disability determinations service 17 established pursuant to 42 U.S.C. 421, and shall perform such other duties 18 relating to labor and workforce development as may be imposed upon him by law. 19 The director shall be the successor in law to the office enumerated in section 20 1, article XIII, of the constitution of the state of Idaho. The director shall 21 have the authority to employ individuals, make expenditures, require reports, 22 make investigations, perform travel and take other actions deemed necessary. 23 The director shall organize the department of labor which is hereby created, 24 and which shall, for the purposes of section 20, article IV, of the constitu- 25 tion of the state of Idaho, be an executive department of the state govern- 26 ment. The director shall have an official seal which shall be judicially 27 noticed. 28 (2) The director shall have the authority pursuant to chapter 52, title 29 67, Idaho Code, to adopt, amend, or rescind rules as he deems necessary for 30 the proper performance of all duties imposed upon him by law. 31 (3) Subject to the provisions of chapter 53, title 67, Idaho Code, the 32 director is authorized and directed to provide for a merit system for the 33 department covering all persons, except the director, the division administra- 34 tors, employees of the Idaho career information system, and two (2) exempt 35 positions to serve at the pleasure of the director. 36 (4) The director shall make recommendations for amendments to the employ- 37 ment security law and other laws he is charged to implement as he deems 38 proper. 39 (5) The director shall have all the powers and duties as may have been or 40 could have been exercised by his predecessors in law, except those powers and 41 duties granted and reserved to the director of the department of commerce in 42 titles 39, 49 and 67, Idaho Code, and he shall be the successor in law to all 43 contractual obligations entered into by his predecessors in law, except for 2 1 those contracts of the department of commerce, or contracts pertaining to any 2 power or duty granted and reserved to the director of the department of com- 3 merce, in titles 39, 49 and 67, Idaho Code. 4 SECTION 2. That Chapter 13, Title 72, Idaho Code, be, and the same is 5 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 6 ignated as Section 72-1345A, Idaho Code, and to read as follows: 7 72-1345A. IDAHO CAREER INFORMATION SYSTEM. The Idaho career information 8 system is hereby established within the department to provide current and 9 accurate occupational, educational and related career information to help 10 Idaho citizens understand the link between educational preparation and work, 11 explore education and career alternatives, and successfully seek work. The 12 Idaho career information system shall be responsible for carrying out the 13 duties required by section 118 of the Carl D. Perkins career and technical 14 education act of 2006 (20 U.S.C. 2328(c)), as amended. All moneys received by 15 the Idaho career information system for its products and services shall be 16 deposited in the career information system account, which is hereby estab- 17 lished in the state treasury, and are perpetually appropriated to the director 18 for the administration of the Idaho career information system. Employees of 19 the Idaho career information system shall be nonclassified employees exempt 20 from the provisions of chapter 53, title 67, Idaho Code. The workforce devel- 21 opment council established pursuant to section 72-1336, Idaho Code, shall 22 serve as an advisory body to the department on matters related to the Idaho 23 career information system.

STATEMENT OF PURPOSE RS 17374 The Idaho Career Information System has operated continuously under Executive Orders since 1980 as a cooperative venture between the Idaho Department of Commerce, the Idaho Department of Labor, the Idaho State Board of Education, the Idaho Division of Vocational Rehabilitation, the Office of the Governor, and the Division of Professional-Technical Education. The purpose of the Idaho Career Information System is to provide current and accurate occupational, educational and related career information to help Idaho citizens understand the link between educational preparation and work, explore education and career alternatives, and successfully seek work. The primary subscribers of the products and services provided by the Idaho Career Information System include 93% of secondary schools, colleges, universities, Idaho Department of Labor local offices, Vocational Rehabilitation local offices, and correctional facilities. This legislation establishes the Idaho Career Information System within the Idaho Department of Labor because the services and products provided by the Idaho Career Information System are critical components of the Department’s employment service and its workforce development programs. Having the Idaho Career Information System administered by the Department will create efficiencies and reduce the system’s costs because the Department will update the Idaho Career Information System’s computer technology and improve its access to information available through the Department’s Research and Analysis Bureau. Locating the Idaho Career Information System within the Department of Labor will allow the Department to promote the system through Department initiatives, thereby providing better public access to career related information at the Department’s 24 statewide local offices. FISCAL NOTE The Idaho Career Information System is included in the appropriated budget for the Division of Professional-Technical Education for State Fiscal Year 2008. The enactment of this legislation will have a positive fiscal impact of $213,900 on the State General Fund. The Idaho Career Information System will be funded by moneys generated by the Idaho Career Information System and, if necessary, by the Department’s Special Administration Fund, Section 72-1347A, Idaho Code.
