                              BY JUDICIARY AND RULES COMMITTEE

  1                                        AN ACT
  2    RELATING TO SALARIES AND DISTRICT COURT REPORTERS;  AMENDING  SECTION  1-1102,
  3        IDAHO  CODE,  TO REVISE PROVISIONS RELATING TO COURT REPORTER SALARIES, TO
  4        DELETE OBSOLETE LANGUAGE AND TO DELETE PROVISIONS RELATING TO  SALARY  AND
  5        ORDER OF TRANSCRIPTS PREPARED.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That  Section  1-1102, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

  9        1-1102.  OATH, BOND, SALARY AND EXPENSES -- COST  OF  LIVING  ADJUSTMENTS.
 10    (1)  Said  reporter  shall  take the oath required to be taken by the judicial
 11    officers; and be bonded to the state of Idaho in  the  form  and  manner  pre-
 12    scribed  by  chapter  8,  title 59, Idaho Code; and hold his office during the
 13    pleasure of said judge,. and shall receive an annual salary commencing on July
 14    1, 1989, according to the following schedule:

 21    The salary salaries of district court reporters shall be paid on  regular  pay
 22    periods not less frequently than monthly as determined by order of the supreme
 23    court.  The  supreme court may, in its discretion, authorize a higher starting
 24    salary than that set forth in subsection (1) of this section for any shorthand
 25    reporter who has been certified as either a certified  shorthand  reporter  or
 26    registered  public reporter and who has previous court reporting experience in
 27    another state.
 28        (2)  Commencing July 1, 1990, the chief  justice  of  tThe  supreme  court
 29    shall  establish  and maintain, consistent with the provisions of this section
 30    and other applicable provisions of law, a personnel plan  for  district  court
 31    reporters  governing  their  appointment,  promotion,  classification, minimum
 32    qualifications, compensation, expenses,  leave,  transfer,  lay-off,  removal,
 33    discipline   and  other  incidents  of  employment  of  those  district  court
 34    reporters. The salary schedule promulgated pursuant to the authority conferred
 35    in this section shall be of temporary effect and must be ratified by the  leg-
 36    islature  at the regular legislative session first following its adoption. Any
 37    such salary schedule, or portions thereof, not approved in  the  above  manner
 38    shall  be  rejected, null and void and of no force and effect on July 1 of the
 39    year, following submission of such schedule to the legislature. Provided, how-
 40    ever, that any such salary schedule, or portions thereof, previously  ratified
 41    by  the  legislature  in the manner provided for herein shall continue in full
 42    force and effect until modified in the manner  provided  for  herein.  To  the
 43    extent possible, the personnel plan shall recognize performance as measured by

  1    factors such as productivity, reliability, effectiveness and longevity.
  2        (3)  There  shall be paid in addition to said salary, to each of the court
  3    reporters of the district courts, out of the state treasury, for each term  of
  4    district  court  held  by  the judge thereof, for the trial and disposition of
  5    causes and the transaction of business under the laws of the state,  in  other
  6    counties than that in which said court reporter resides, his actual and neces-
  7    sary  expenses  for traveling and attending each term: provided, however, that
  8    no stenographic reporter shall be paid his salary,  or  any  portion  thereof,
  9    unless  he  shall have first taken and subscribed an oath that he has prepared
 10    the transcript of the testimony on  appeal  either  in  a  civil  or  criminal
 11    action,  or  specified  portion thereof, in the order in which the copy of the
 12    order directing him to prepare the same has been served  upon  him:  provided,
 13    however,  that  the  estimated cost of transcribing such transcript shall have
 14    been paid to such reporter at the time of the service of the copy of the order
 15    upon him.

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE

  This bill amends Idaho Code  1-1102, which addresses
  the salaries, bonds, oaths and expenses of court reporters. 
  These changes have been recommended by the Supreme Court
  based on recommendations of its Court Reporter Subcommittee. 
  The bill removes obsolete language regarding the salaries
  set for court reporters in 1989 and allows the Legislature
  to continue to approve changes in employee compensation for
  court reporters through the normal CEC and appropriation
  process for state employees.  The bill also removes a
  provision of the statute requiring a court reporter to take
  an oath that the reporter has prepared transcripts in the
  order in which the orders for such transcripts have been
  served, since this is often not the most efficient or
  appropriate order in which to prepare such transcripts.
