]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1282 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE LOTTERY; AMENDING SECTION 67-7410, IDAHO CODE, TO REVISE 3 THE AUTHORITY OF THE LOTTERY'S SECURITY DIRECTOR TO REQUIRE FINGERPRINT- 4 BASED CRIMINAL HISTORY CHECKS USING THE STATE CENTRAL DATABASE AND THE 5 FEDERAL BUREAU OF INVESTIGATION'S CRIMINAL HISTORY DATABASE ON PROSPECTIVE 6 EMPLOYEES, VENDORS, CONTRACTORS, LOTTERY RETAILERS AND BINGO AND RAFFLE 7 OPERATORS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 67-7410, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 67-7410. DIRECTOR OF LOTTERY SECURITY. The director shall hire a security 12 director who shall manage the lottery's security division. The security divi- 13 sion shall be responsible for the performance of background investigations of 14 employees, lottery retailers, bingo and raffle operators, vendors and major 15 procurement contractors and for the enforcement of the criminal provisions of 16 this chapter. In addition, the security division shall develop a security plan 17 to be implemented by the lottery. The lottery's security division is herein 18 designated as an Idaho law enforcement agency. The director of security has 19 the authority to: 20 (1) Issue administrative subpoenas during the conduct of investigations 21 in accordance with commission rules and this chapter; 22 (2) Require fingerprint-basedand background checks ofcriminal history 23 check of the Idaho central database and the federal bureau of investigation's 24 criminal history database on prospective employees,andvendors, contractors, 25 lottery retailers and bingo and raffle operators; and 26 (3) Access criminal offender record information from the Idaho state 27 police for the purpose of background or other investigations performed in 28 accordance with this chapter. 29 Such information obtained and kept by the security director shall be sub- 30 ject to disclosure according to chapter 3, title 9, Idaho Code. Nothing herein 31 shall prohibit the lottery from disclosing information obtained by it to law 32 enforcement agencies or other lottery organizations for security or enforce- 33 ment purposes.
STATEMENT OF PURPOSE
RS 17418
The Federal Bureau of Investigation requires state agencies to have
state statutory authority to request access the FBI criminal
history database.
