                                    SENATE BILL NO. 1284

  1                                        AN ACT
  2    RELATING TO HORSE RACING; AMENDING SECTION 54-2510, IDAHO CODE, TO PROVIDE FOR
  3        BONUSES FOR IDAHO BRED WINNERS, TO PROVIDE THAT CERTAIN RACES MAY BE WRIT-
  4        TEN AS IDAHO BRED PREFERRED RACES, TO PROVIDE FOR THE PAYMENT  OF  A  PER-
  5        CENTAGE  OF  FIRST  PLACE PURSE MONEY BY LICENSEES TO BREEDERS, TO PROVIDE
  6        THAT CERTAIN MONEYS SHALL BE INCLUDED AND  CERTAIN  MONEYS  EXCLUDED  FROM
  7        CALCULATION OF BREEDER PAYMENTS AND TO MAKE A TECHNICAL CORRECTION.

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION  1.  That  Section 54-2510, Idaho Code, be, and the same is hereby
 10    amended to read as follows:

 11        54-2510.  RACE EXCLUSIVELY FOR IDAHO BRED HORSES -- BONUS FOR  IDAHO  BRED
 12    WINNERS.  (1)  For the purpose of encouraging the breeding, within this state,
 13    of valuable thoroughbred, purebred and/or registered horses, at least one  (1)
 14    race  each  day at each horse race meet shall be limited to Idaho bred horses.
 15    If in the opinion of the commission sufficient competition cannot be had among
 16    such class of horses, said race may be eliminated for said days and a  substi-
 17    tute provided written as an Idaho bred preferred race instead.
 18        (2)  A  sum  equal  to ten per cent percent (10%) of the first place purse
 19    money of every purse won by an Idaho bred horse shall be paid by the  licensee
 20    conducting  the  race  meet  to  the  breeder  of such horse. All purse moneys
 21    derived from pari-mutuel racing and all  purse  enhancement  moneys  from  the
 22    Idaho  state  racing  commission shall be included in the calculation of these
 23    breeder payments. All nominating and sustaining fees, and any moneys from out-
 24    side sponsors shall be excluded from the calculation  of  these  breeder  pay-
 25    ments.

clarify which portion of the purse that breeders awards are paid
on.
