]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1318 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO HONORARIUMS AND EXPENSES; AMENDING SECTION 20-208, IDAHO CODE, TO 3 REVISE COMPENSATION PROVISIONS REGARDING THE STATE BOARD OF CORRECTION; 4 AND AMENDING SECTION 59-509, IDAHO CODE, TO PROVIDE FOR SPECIFIED PER DIEM 5 HONORARIUM AND FOR ACTUAL AND NECESSARY EXPENSES OF MEMBERS OF PART-TIME 6 BOARDS, COMMISSIONS OR COUNCILS AND TO MAKE TECHNICAL CORRECTIONS. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 20-208, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 20-208. SALARIES AND EXPENSES OF BOARD MEMBERS. Each member of the state 11 board of correction shall be compensated as provided by section 59-509(hq), 12 Idaho Code. 13 SECTION 2. That Section 59-509, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 59-509. HONORARIUMS OR COMPENSATION FOR MEMBERS OF BOARDS, COMMISSIONS 16 AND COUNCILS. The members of part-time boards, commissions or councils shall 17 receive for each day spent in the actual performance of duties, an honorarium, 18 compensation, or expenses, as provided in the following schedule: 19 (a) Members shall serve without honorarium, compensation, or expense 20 reimbursement of any kind. 21 (b) Members shall serve without honorarium or compensation of any kind, 22 but shall be reimbursed for actual and necessary expenses, subject to the lim- 23 its provided in section 67-2008, Idaho Code. 24 (c) Members shall serve without honorarium or compensation of any kind, 25 but shall be reimbursed for actual and necessary expenses, without being sub- 26 ject to the limits provided in section 67-2008, Idaho Code. 27 (d) Members shall receive the sum of fifteen dollars ($15.00) per day, 28 and shall be reimbursed for actual and necessary expenses, subject to the lim- 29 its provided in section 67-2008, Idaho Code. 30 (e) Members shall receive the sum of twenty dollars ($20.00) per day, and 31 shall be reimbursed for actual and necessary expenses, subject to the limits 32 provided in section 67-2008, Idaho Code. 33 (f) Members shall receive the sum of twenty-five dollars ($25.00) per 34 day, and shall be reimbursed for actual and necessary expenses, subject to the 35 limits provided in section 67-2008, Idaho Code. 36 (g) Members shall receive the sum of thirty-five dollars ($35.00) per 37 day, and shall be reimbursed for actual and necessary expenses, subject to the 38 limits provided in section 67-2008, Idaho Code. 39 (h) Members shall receive the sum of fifty dollars ($50.00) per day, and 40 shall be reimbursed for actual and necessary expenses, subject to the limits 41 provided in section 67-2008, Idaho Code. 2 1 (i) Members shall receive the sum of seventy-five dollars ($75.00) per 2 day, and shall be reimbursed for actual and necessary expenses, subject to 3 the limits provided in section 67-2008, Idaho Code. 4 (j) Members shall receive an honorarium in the sum of fifteen dollars 5 ($15.00) per day, and shall be reimbursed for actual and necessary expenses, 6 subject to the limits provided in section 67-2008, Idaho Code, unless other- 7 wise provided by statute. Payment of an honorarium as provided in this subsec- 8 tion shall not be considered salary as defined in section 59-1302(31), Idaho 9 Code. 10 (k) Members shall receive an honorarium in the sum of twenty dollars 11 ($20.00) per day, and shall be reimbursed for actual and necessary expenses, 12 subject to the limits provided in section 67-2008, Idaho Code. Payment of an 13 honorarium as provided in this subsection shall not be considered salary as 14 defined in section 59-1302(31), Idaho Code. 15 (l) Members shall receive an honorarium in the sum of twenty-five dollars 16 ($25.00) per day, and shall be reimbursed for actual and necessary expenses, 17 subject to the limits provided in section 67-2008, Idaho Code. Payment of an 18 honorarium as provided in this subsection shall not be considered salary as 19 defined in section 59-1302(31), Idaho Code. 20 (m) Members shall receive an honorarium in the sum of thirty-five dollars 21 ($35.00) per day, and shall be reimbursed for actual and necessary expenses, 22 subject to the limits provided in section 67-2008, Idaho Code. Payment of an 23 honorarium as provided in this subsection shall not be considered salary as 24 defined in section 59-1302(31), Idaho Code. 25 (n) Members shall receive an honorarium in the sum of fifty dollars 26 ($50.00) per day, and shall be reimbursed for actual and necessary expenses, 27 subject to the limits provided in section 67-2008, Idaho Code. Payment of an 28 honorarium as provided in this subsection shall not be considered salary as 29 defined in section 59-1302(31), Idaho Code. 30 (o) Members shall receive an honorarium in the sum of seventy-five dol- 31 lars ($75.00) per day, and shall be reimbursed for actual and necessary 32 expenses, subject to the limits provided in section 67-2008, Idaho Code. Pay- 33 ment of an honorarium as provided in this subsection shall not be considered 34 salary as defined in section 59-1302(31), Idaho Code. 35 (p) Members shall receive an honorarium in the sum of one hundred dollars 36 ($100) per day, and shall be reimbursed for actual and necessary expenses, 37 subject to the limits provided in section 67-2008, Idaho Code. Payment of an 38 honorarium as provided in this subsection shall not be considered salary as 39 defined in section 59-1302(31), Idaho Code. 40 (q) Members shall receive an honorarium in the sum of one hundred fifty 41 dollars ($150) per day, and shall be reimbursed for actual and necessary 42 expenses, subject to the limits provided in section 67-2008, Idaho Code. REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS 17320 The purpose of these proposed changes is to adjust the compensation received by the Board of Correction. The Board of Correction has oversight and policy-making responsibilities over the state's second largest agency. The Board's current compensation is fifty dollars ($50) per day. By way of a brief history, the compensation of the Board of Correction was set at $4,000 per year, plus expenses, in 1947. See Idaho Session Laws 1947, chapter 53, Section 8. In 1951, the legislature enacted Idaho Code Section 20-208, which at that time set the Board's compensation at $5,000 per year plus expenses. See Idaho Session Laws 1951, chapter 217. Section 1. The Board's current compensation was set when Idaho Code Section 20-208 was amended in 1969 to provide for a daily salary of $50, plus expenses. See Idaho Session Laws 1969, chapter 97, Section 4. Thus, the Board's compensation has apparently remained unchanged for the past 38 years. FISCAL NOTE The fiscal impact is an increase from $4,500 in personnel costs to $8,000.
