]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1333 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO WILLS; AMENDING SECTION 15-2-502, IDAHO CODE, TO PROVIDE CERTAIN 3 EXCEPTIONS TO THE EXECUTION OF WILLS AND TO MAKE TECHNICAL CORRECTIONS; 4 AND AMENDING SECTION 15-2-504, IDAHO CODE, TO PROVIDE FOR THE EXECUTION, 5 MAKING AND ATTESTING OF SELF-PROVED WILLS AND TO MAKE TECHNICAL CORREC- 6 TIONS. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 15-2-502, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 15-2-502. EXECUTION. Except as provided for holographic wills, writings 11 within section 15-2-513 of thisPpart, and wills within section 15-2-506 of 12 thisPpart, or except as provided in sections 51-109, 55-712A or 55-712B, 13 Idaho Code, every will shall be in writing signed by the testator or in the 14 testator's name by some other person in the testator's presence and by his 15 direction, and shall be signed by at least two (2) persons each of whom wit- 16 nessed either the signing or the testator's acknowledgment of the signature or 17 of the will. 18 SECTION 2. That Section 15-2-504, Idaho Code, be, and the same is hereby 19 amended to read as follows: 20 15-2-504. SELF-PROVED WILL. STATEMENT OF PURPOSE RS: 17519 Last session, methods were instituted for signing and notarizing documents when the signer either was illiterate or was unable physically to sign. This bill incorporates those methods into the execution of a Will. Both the actual execution of the Will and the self-proving of a Will (whereby the witnesses and signer state under oath that the necessary requirements for proper execution of a valid Will were met) are covered.
