]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1356 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO COUNTY SHERIFFS; AMENDING SECTION 34-618, IDAHO CODE, TO REVISE 3 QUALIFICATION PROVISIONS AND TO PROVIDE FOR CERTAIN TRAINING FOLLOWING 4 ELECTION TO THE OFFICE OF SHERIFF FOR THE FIRST TIME. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 34-618, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 34-618. ELECTION OF COUNTY SHERIFFS -- QUALIFICATIONS. (1) At the general 9 election, 1972, and every four (4) years thereafter, a sheriff shall be 10 elected in every county. 11 (2) No person shall be elected to the office of sheriff unless he has 12 attained the age of twenty-one (21) years and is not a convicted felon at the 13 time ofhiselection, is a citizen of the United States and shall have resided 14 within the county one (1) year next preceding his election. 15 (3) Each candidate shall file his declaration of candidacy with the 16 county clerk. 17 (4) Each candidate who files a declaration of candidacy shall at the same 18 time pay a filing fee of forty dollars ($40.00) which shall be deposited in 19 the county treasury. 20 (5) Each person who has been elected to the office of sheriff for the 21 first time shall complete a tutorial concerning current Idaho law and rules as 22 prescribed by the Idaho peace officers standards and training academy, unless 23 the person is already certified as a chief of police, peace officer or deten- 24 tion deputy in the state of Idaho, and shall attend the newly elected sher- 25 iffs' school sponsored by the Idaho sheriffs' association.

STATEMENT OF PURPOSE
RS 17680
The purpose of this bill is to require a newly elected
sheriff to seek training sponsored by the POST Council and the
Idaho Sheriff's Association.
FISCAL IMPACT
There will be no impact on the general fund of the state as
a result of this bill.
