]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1357 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO FALSE PRETENSES AND MISREPRESENTATIONS; AMENDING SECTION 18-3126, 3 IDAHO CODE, TO REVISE THE PROHIBITION AGAINST MISAPPROPRIATION OF PERSONAL 4 IDENTIFYING INFORMATION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 18-3126, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 18-3126. MISAPPROPRIATION OF PERSONAL IDENTIFYING INFORMATION. It is 9 unlawful for any person to obtain or record personal identifying information 10 of another person without the authorization of that person, with the intent 11 that the information be used to obtain, or attempt to obtain, credit, money, 12 goods or servicesin the name of the other personwithout the consent of that 13 person.
STATEMENT OF PURPOSE
RS 17700
The purpose of this legislation is to clarify the current
Misappropriation of Personal Identifying Information criminal
statute. The current law prohibits an offender from obtaining
or recording, without authority, another person's social
security number or date of birth with the intent to use that
information in order to obtain credit, money, goods or
services in the name of the other person.
However, in many instances of identity theft an offender
utilizes a stolen social security number or date of birth and
their own name or a fictitious name in obtaining credit,
money, goods or services.
This legislation clarifies the law and will ensure that
law enforcement and prosecutors are better able to hold
identity thieves accountable under these circumstances.
