  1                                        AN ACT
  2    RELATING TO THE PUBLIC SCHOOL FOUNDATION PROGRAM; AMENDING  SECTION  33-1004A,
  3        IDAHO  CODE,  TO  REVISE  A REQUIREMENT USED IN DETERMINING THE EXPERIENCE
  4        FACTOR OF THE EXPERIENCE AND EDUCATION MULTIPLIER; DECLARING AN  EMERGENCY
  5        AND PROVIDING RETROACTIVE APPLICATION.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That Section 33-1004A, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

  9        33-1004A.  EXPERIENCE AND EDUCATION  MULTIPLIER.  Each  instructional  and
 10    administrative  staff  position  shall  be  assigned an appropriate multiplier
 11    based upon the following table:

 30        In determining the experience factor, the  actual  years  of  teaching  or
 31    administrative  service  in an accredited public school, in an accredited pri-
 32    vate or parochial school, or beginning in the 2005-06 school year and thereaf-
 33    ter in an accredited college or university shall be credited.
 34        In determining the education factor, only  credits  earned  after  initial
 35    certification,  based upon a transcript on file with the teacher certification
 36    office of the state department of  education,  earned  at  an  institution  of
 37    higher  education  accredited  by  the  state board of education or a regional
 38    accrediting association, shall be allowed. Instructional staff  whose  initial
 39    certificate  is  an occupational specialist certificate shall be treated as BA
 40    degree prepared instructional staff. Credits earned by such occupational  spe-
 41    cialist  instructional  staff  after  initial  certification shall be credited

  1    toward the education factor.
  2        In determining the statewide average multiplier for  instructional  staff,
  3    no  multiplier  in  excess  of  1.59092 shall be used. If the actual statewide
  4    average multiplier for instructional staff, as  determined  by  this  section,
  5    exceeds  1.59092,  then  each school district's instructional staff multiplier
  6    shall be multiplied by the result of 1.59092 divided by the  actual  statewide
  7    average multiplier for instructional staff.
  8        In  determining the statewide average multiplier for administrative staff,
  9    no  multiplier in excess of 1.86643 shall be used.  If  the  actual  statewide
 10    average  multiplier  for  administrative staff, as determined by this section,
 11    exceeds 1.86643, then each school district's administrative  staff  multiplier
 12    shall  be  multiplied by the result of 1.86643 divided by the actual statewide
 13    average multiplier for administrative staff.

 14        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 15    declared to exist, this act shall be in full force and effect on and after its
 16    passage and approval, and retroactively to July 1, 2007.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17865

This legislation makes a technical correction to Idaho Code. 
When the State Board of Education removed the requirement that
Idaho's public elementary schools be accredited, it had an
unintended impact on teachers teaching in those elementary
schools.  Under Idaho Code, as currently written, teachers
receive an additional salary multiplier of 3.75% for each year
that they teach in an "accredited" public school, up to a maximum
of 13 years.  Since elementary schools are no longer accredited,
this means that elementary school teachers would not receive
their annual salary multiplier increase for teaching an
additional year.  This legislation corrects this unintended
impact.  



                           FISCAL NOTE

Since the Public Schools budget already includes base funding for
the additional years of experience earned by elementary school
teachers, there is no additional fiscal impact as a result of
this legislation.
