                       STATEMENT OF PURPOSE

                             RS 17837

The purpose of this legislation is to extend the current time
limitation for filing notice of intent to seek the death penalty in
capital cases.
This proposal extends that time limitation from thirty (30)
days to sixty (60) days. In addition, the proposal would in the
alternative allow the state and defense to stipulate or agree to a
different time limitation as deemed reasonable by the court.
The basis for this extension is to allow both the state and
the defense additional time in order to conduct investigations into
aggravating and mitigating circumstances. The purpose of these
investigations is to ascertain whether or not aggravating
circumstances can be proven beyond a reasonable doubt, and further
that the aggravating circumstances are not outweighed by mitigating
circumstances.

                           FISCAL NOTE

There is no fiscal impact to the state's general fund.
