SHERIFF - COMPENSATION - Amends existing law to provide that in instances
where the sheriff or other county officer performs a service on behalf of
the people of the state, the claim for compensation shall be filed with the
Board of Examiners and, if approved, paid by the Department of Correction
to the treasurer of the county of the sheriff or other officer who
performed the service.

]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1432 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO COMPENSATION TO COUNTIES FOR SERVICES TO THE STATE; AMENDING SEC- 3 TION 31-2219, IDAHO CODE, TO PROVIDE THAT IN INSTANCES WHERE THE SHERIFF 4 OR OTHER COUNTY OFFICER PERFORMS A SERVICE ON BEHALF OF THE PEOPLE OF THE 5 STATE, THE CLAIM FOR COMPENSATION SHALL BE FILED WITH THE BOARD OF EXAMIN- 6 ERS AND IF APPROVED PAID BY THE DEPARTMENT OF CORRECTION TO THE TREASURER 7 OF THE COUNTY OF THE SHERIFF OR OTHER OFFICER WHO PERFORMED THE SERVICE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 31-2219, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 31-2219. COMPENSATION FOR SERVICES TO STATE. When the sheriff or other 12 officer is legally required to perform a serviceinon behalf of the people of 13 this state, which is not chargeable to his county or private person, his 14 account and claim for compensationthereformust be filed with the board of 15 examiners, who shall consider and, if appropriate, approve and submit the same 16and report thereon to the legislature, at its first session after the rendi-17tion of such service, for its action. The board of examiners shall request an18appropriation for such claim. If the legislature appropriates funds for such19claim, the amount shall be paid by the board of examinersto the Idaho depart- 20 ment of correction who shall pay the claim to the treasurer of the county of 21 the sheriff or other officer who performed the services.
STATEMENT OF PURPOSE
RS17866
This bill makes changes to 31-2219, Idaho Code, relating to
compensation for services to the State by county sheriffs. This
change would speed up the process so that claims could be paid
within 60 days, consistent with 67-2302 Idaho Code, after approval
of the claim by the Board of Examiners.
FISCAL NOTE
The claims are currently being paid from the General Fund, however
under current Idaho Code there may be a delay of up to one year
before the claim can be paid. The current average yearly amount
of these claims is less than $30,000.
