]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1435 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE DEPARTMENT OF ADMINISTRATION; REPEALING SECTION 58-330, IDAHO 3 CODE, RELATING TO THE INTEGRATED PROPERTY RECORDS SYSTEM; AMENDING CHAPTER 4 57, TITLE 67, IDAHO CODE, BY THE ADDITION OF NEW SECTIONS 67-5779, 5 67-5780, 67-5781 AND 67-5782, IDAHO CODE, TO DEFINE TERMS, TO PROVIDE 6 DUTIES AND POWERS OF THE DIRECTOR OF THE DEPARTMENT OF ADMINISTRATION, TO 7 SET FORTH THAT STATE AGENCIES ARE TO PROVIDE CERTAIN RECORDS AND DATA, AND 8 TO PROVIDE THAT THE RESPONSIBILITY FOR QUALITY REMAINS WITH THE 9 ORIGINATOR. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Section 58-330, Idaho Code, be, and the same is hereby 12 repealed. 13 SECTION 2. That Chapter 57, Title 67, Idaho Code, be, and the same is 14 hereby amended by the addition thereto of NEW SECTIONS, to be known and desig- 15 nated as Sections 67-5779, 67-5780, 67-5781 and 67-5782, Idaho Code, and to 16 read as follows: 17 67-5779. DEFINITIONS. As used in sections 67-5780, 67-5781 and 67-5782, 18 Idaho Code: 19 (1) "Geographic information" means data and datasets containing location 20 information including, but not limited to, remotely sensed imagery, global 21 positioning systems files, geospatially referenced computer-aided design 22 files, digital cartographic products, spatially enabled databases, and 23 geospatial datasets locating and describing features and their attributes on, 24 above or under the earth; 25 (2) "Geographic information systems" or "GIS" is an information system 26 capable of capturing, integrating, storing, editing, analyzing, managing, 27 sharing, and displaying geographic information. A GIS involves computer hard- 28 ware, software, networks, and applications, as well as the people to operate, 29 develop, administer and use them; 30 (3) "Metadata" is a description of the quality, currency, attributes, 31 methods and other salient aspects of geographic and tabular information; and 32 (4) "State agency" means all state agencies or departments, boards, com- 33 missions, councils and institutions of higher education but shall not include 34 the elected constitutional officers and their staffs, the legislature and its 35 staffs or the judiciary. 36 67-5780. INTEGRATED PROPERTY RECORDS SYSTEM -- TRANSFER OF RESPONSIBIL- 37 ITY. The department of administration: 38 (1) Shall take possession and control of the state's integrated property 39 records system previously created pursuant to section 58-330, Idaho Code; 40 (2) Shall manage the state's integrated property records system; 41 (3) Shall lead the establishment of a standard format, workflow and tech- 2 1 nical procedures to permit update of the integrated property records system 2 with geographic and other relevant data and information received from state 3 agencies; and 4 (4) Shall lead the planning and deployment of multiagency enterprise use 5 of the integrated property records system. 6 67-5781. AGENCIES TO PROVIDE RECORDS AND DATA. (1) Every state agency 7 shall, no later than January 15, 2009, provide records, in an electronic 8 format acceptable to the department of administration, of all interests in any 9 real property owned, used or granted by it including, without limitation, 10 records of ownership, leases, encumbrances, easements, rights-of-way leases or 11 any other interest in real property, and on a regular and continuous basis, 12 update such records and provide any new records to the department of adminis- 13 tration. Metadata will accompany all state agency records. 14 (2) For purposes of this section, state agencies shall provide only 15 records and geographic information that are subject to disclosure under chap- 16 ter 3, title 9, Idaho Code, or that the agency has determined to disclose as a 17 public record. 18 67-5782. RESPONSIBILITY FOR QUALITY. In regard to any obligation on any 19 state agency or other entity to provide records to the department of adminis- 20 tration pursuant to section 67-5780 or 67-5781, Idaho Code, the obligation for 21 quality remains with the originator and does not transfer to the department of 22 administration by virtue of its receipt or by integration or other use of such 23 records.

STATEMENT OF PURPOSE RS 17908 This legislation would repeal Idaho Code Section 58-330 referencing the integrated property records system in the department of lands and replace it with new code sections in chapter 57, title 67, Idaho Code, to do the following: Transfer the responsibility for the integrated property records system to the department of administration. Provide definitions. Provide duties and powers of the director regarding the integrated property records system. Provide duties of state agencies with regard to providing information to department of administration and a date for such information to be contributed. Provide for the responsibility for data quality and documentation. Existing Idaho code Section 58-330 was enacted in 2000. It requires the department of lands to maintain an integrated property records system GIS database for state real property interests. The transfer of this responsibility to the department of administration will facilitate access and effective use of the existing information by state and local governments and the public. The department of administration, by virtue of its statutory mandates and expertise related to public works, leasing of commercial property by state agencies, state communications systems and information technology, is well suited to lead the maintenance, improvement and enterprise aspects of this information resource. This is the first step of a multi-step pathway to develop, maintain and provide access to commonly needed base geospatial information by a collaborative, multi-agency, multi-governmental effort that benefits all Idahoans and beyond. FISCAL Impact This transfer of responsibility flows with one (1) FTE and $50,000 in general fund budget authority from the department of lands to the department of administration. The department of administration has requested an additional $32,900 in General Fund budget authority to fully fund the position. The total additional (new money) cost to the state from the general fund is $32,900. No other impact to the General Fund.
