  1                                        AN ACT
  2    RELATING TO SPECIAL MOTOR VEHICLE LICENSE  PLATES;  AMENDING  SECTION  49-402,
  3        IDAHO  CODE,  TO  PROVIDE  A CODE REFERENCE; AMENDING CHAPTER 4, TITLE 49,
  4        IDAHO CODE, BY THE ADDITION OF A  NEW  SECTION  49-415E,  IDAHO  CODE,  TO
  5        ESTABLISH  THE  IDAHO  2009  SPECIAL  OLYMPICS  WORLD WINTER GAMES SPECIAL
  6        LICENSE PLATE PROGRAM; AND DECLARING AN EMERGENCY.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION 1.  That Section 49-402, Idaho Code, be, and the  same  is  hereby
  9    amended to read as follows:

 10        49-402.  ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
 11    truck,  each neighborhood electric vehicle and each other motor vehicle having
 12    a maximum gross weight not in excess of eight thousand  (8,000)  pounds  shall
 13    be:
 14        Vehicles one (1) and two (2) years old ............................ $48.00
 15        Vehicles three (3) and four (4) years old ......................... $36.00
 16        Vehicles five (5) and six (6) years old ........................... $36.00
 17        Vehicles seven (7) and eight (8) years old ........................ $24.00
 18        Vehicles over eight (8) years old ................................. $24.00
 19        There  shall  be twelve (12) registration periods, starting in January for
 20    holders of validation registration stickers numbered 1, and proceeding consec-
 21    utively through December for holders of validation registration stickers  num-
 22    bered  12,  each of which shall start on the first day of a calendar month and
 23    end on the last day of the twelfth month from the first day of  the  beginning
 24    month.  Registration periods shall expire midnight on the last day of the reg-
 25    istration period  in  the  year  designated  by  the  validation  registration
 26    sticker.  The  numeral digit on the validation registration stickers shall, as
 27    does the registration card, fix the registration period  under  the  staggered
 28    plate  system of Idaho for the purpose of reregistration and notice of expira-
 29    tion.
 30        A vehicle that has once been registered for any of  the  above  designated
 31    periods  shall,  upon reregistration, be registered for the period bearing the
 32    same number, and the registration card shall show and be the  exclusive  proof
 33    of  the  expiration  date  of registration and licensing. Vehicles may be ini-
 34    tially registered for less than a twelve (12) month period, or for more than a
 35    twelve (12) month period, and the fee prorated on a monthly basis if the frac-
 36    tional registration tends to fulfill the purpose of the monthly series  regis-
 37    tration system.
 38        (2)  For all school buses operated either by a nonprofit, nonpublic school
 39    or  operated  pursuant to a service contract with a school district for trans-
 40    porting children to or from school  or  in  connection  with  school  approved
 41    activities, the annual fee shall be twenty-four dollars ($24.00).
 42        (3)  For all motorcycles and all-terrain vehicles operated upon the public
 43    highways  the  annual  fee  shall be nine dollars ($9.00). For operation of an

  1    all-terrain vehicle or motorcycle off the public highways, the  fee  specified
  2    in  section  67-7122,  Idaho Code, shall be paid. Registration exemptions pro-
  3    vided in section 49-426(2), (3) and (4),  Idaho  Code,  apply  to  all-terrain
  4    vehicles  and  motorcycles used for the purposes described in subsections (2),
  5    (3) and (4) of section 49-426, Idaho Code.
  6        (4)  For all motor homes the fee shall be as specified in  subsection  (1)
  7    of   this section and shall be in addition to the fees provided for in section
  8    49-445, Idaho Code.
  9        (5)  Registration fees shall not be subject to refund.
 10        (6)  A financial institution  or  repossession  service  contracted  to  a
 11    financial  institution  repossessing  vehicles  under  the terms of a security
 12    agreement shall move the vehicle from the place of repossession to the  finan-
 13    cial institution's place of business on a repossession plate. The repossession
 14    plate  shall  also be used for demonstrating the vehicle to a prospective pur-
 15    chaser for a period not to exceed ninety-six (96) hours. The registration fees
 16    for repossession plates shall be as required in subsection (1) of this section
 17    for a vehicle one (1) and two (2) years old. All  other  fees  required  under
 18    chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
 19    The repossession plate shall be issued on an annual basis by the department.
 20        (7)  In  addition  to  the  annual registration fee in this section, there
 21    shall be an initial program fee of twenty-five dollars ($25.00) and an  annual
 22    program fee of fifteen dollars ($15.00) for all special license plate programs
 23    for  those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
 24    49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho  Code.  For  special  plates
 25    issued  pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an
 26    initial program fee of twenty-five dollars ($25.00)  but  there  shall  be  no
 27    annual  renewal  fee.  For special plates issued pursuant to sections 49-415C,
 28    49-415D,  49-415E,  49-416A,  49-416B,  49-416C,  49-416D,  49-416E,   49-417,
 29    49-417A,   49-417B,  49-417C,  49-418A,  49-418B,  49-418C,  49-418E,  49-419,
 30    49-419A,  49-419B,  49-419C,  49-419D,  49-420,  49-420A,  49-420B,   49-420C,
 31    49-420D,  49-420E  and  49-420G, Idaho Code, there shall be an initial program
 32    fee of thirty-five dollars ($35.00) and an annual program fee  of  twenty-five
 33    dollars ($25.00). The fees contained in this subsection shall be applicable to
 34    all new special plate programs. The initial program fee and the annual program
 35    fee  shall be deposited in the state highway account and shall be used to fund
 36    the cost of administration of special license plate programs, unless otherwise
 37    specified by law.

 38        SECTION 2.  That Chapter 4, Title 49, Idaho Code,  be,  and  the  same  is
 39    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 40    ignated as Section 49-415E, Idaho Code, and to read as follows:

 41        49-415E.  IDAHO 2009 SPECIAL OLYMPICS WORLD WINTER GAMES PLATES.  (1)  Any
 42    person  who  is the owner of a vehicle registered under the provisions of sec-
 43    tion 49-402, Idaho Code, or registered under any  other  section  of  law  for
 44    which  the  purchase  of  special  plates  is allowed, may apply for and, upon
 45    department approval, receive Idaho 2009 special olympics  world  winter  games
 46    license  plates in lieu of regular license plates. The provisions of this sec-
 47    tion shall not apply to any vehicle with a  registered  maximum  gross  weight
 48    over  twenty-six  thousand (26,000) pounds. Availability of Idaho 2009 special
 49    olympics world winter games license plates for other vehicles shall be subject
 50    to the rules, policies and procedures of the department.
 51        (2)  In addition to the regular registration fee required  in  chapter  4,
 52    title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol-
 53    lars  ($35.00)  for  the  initial  issuance of plates, and twenty-five dollars

  1    ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the
  2    initial fee and ten dollars ($10.00) of the renewal fee shall be deposited  in
  3    the state highway account and shall be used to fund the cost of administration
  4    of  this  special  license plate program. Twenty-five dollars ($25.00) of each
  5    initial fee and fifteen dollars ($15.00) of each renewal fee shall  be  trans-
  6    ferred  by  the state treasurer for deposit to the 2009 special olympics world
  7    winter games headquarters in Boise, Idaho, and shall be used  by this interna-
  8    tional nonprofit organization to provide support and assistance to their  pro-
  9    grams  dedicated  to  empowering individuals with intellectual disabilities to
 10    become physically fit, productive and respected  members  of  society  through
 11    sports training and competition.
 12        (3)  Whenever  title  or interest in a vehicle registered under the provi-
 13    sions of this section is transferred or assigned, the owner may  transfer  the
 14    special  plates to another vehicle upon payment of the required transfer fees.
 15    The owner may only display the plates on another vehicle upon receipt  of  the
 16    new registration from the department.
 17        (4)  The  2009  special olympics world winter games license plate shall be
 18    of a color and design in accordance with the provisions  of  section  49-402C,
 19    Idaho  Code. The design and any slogan on the plate shall be acceptable to the
 20    Idaho 2009 special olympics world winter games board of directors and shall be
 21    approved by the transportation department  utilizing  a  numbering  system  as
 22    determined  by  the  department. Initial costs of the plate program, including
 23    costs of plate design, shall be paid by the Idaho 2009 special olympics  world
 24    winter games.
 25        (5)  Sample  Idaho 2009 special olympics world winter games license plates
 26    may be purchased for a fee of thirty dollars ($30.00), ten dollars ($10.00) of
 27    which shall be deposited in the  state  highway  account  and  twenty  dollars
 28    ($20.00) of which shall be transferred to the 2009 special olympics world win-
 29    ter  games  headquarters  in  Boise, Idaho, and shall be used by this interna-
 30    tional nonprofit organization to provide support and assistance to their  pro-
 31    grams  dedicated  to  empowering individuals with intellectual disabilities to
 32    become physically fit, productive and respected  members  of  society  through
 33    sports training and competition.

 34        SECTION  3.  An  emergency  existing  therefor,  which emergency is hereby
 35    declared to exist, this act shall be in full force and effect on and after its
 36    passage and approval.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                            RS 17525C1

The purpose of this bill is to provide recognition for the 2008
World Winter Olympics Games, and to provide funding for the 2009
World Winter Special Olympics Games.  These major events were
solicited by dedicated volunteers and resulted in Idaho being
named host to both the preliminary event this year and the full-
scale Games in 2009.  Funding from the plate will go toward the
promotion of the 2009 Games to generate awareness and support
these tremendous athletes.


                          FISCAL IMPACT

There is no fiscal impact to the State general fund or to the
State Highway Account.  The plate sponsor is responsible for the
programming costs to upgrade the statewide computer system.  This
is estimated to cost $3,900.00, which will be charged to the
sponsoring organization of this particular plate.
