  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE ATTORNEY GENERAL FOR FISCAL  YEAR  2009;  LIMITING
  3        THE  NUMBER  OF  AUTHORIZED  FULL-TIME EQUIVALENT POSITIONS; DIRECTING THE
  4        ATTORNEY GENERAL TO PAY CERTAIN PUBLICATION COSTS FROM THE SPECIAL LITIGA-
  5        TION PROGRAM FOR FISCAL YEAR 2009; REAPPROPRIATING UNEXPENDED AND UNENCUM-
  6        BERED BALANCES OF THE GENERAL FUND; AND SETTING FORTH THE  CONDITIONS  FOR
  7        THE REAPPROPRIATION.

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION  1.  There is hereby appropriated to the Attorney General the fol-
 10    lowing amounts to be expended for the designated  programs  according  to  the
 11    designated  expense classes from the listed funds for the period July 1, 2008,
 12    through June 30, 2009:

 29        SECTION 2.  In accordance with Section 67-3519, Idaho Code,  the  Attorney
 30    General  is  authorized  no  more than two hundred five and fifteen hundredths
 31    (205.15) full-time equivalent positions at any point during the period July 1,
 32    2008, through June 30, 2009, for the programs specified in Section 1  of  this
 33    act,  unless  specifically  authorized  by  the  Governor.  The Joint Finance-
 34    Appropriations Committee will be notified promptly of any increased  positions
 35    so authorized.

 36        SECTION  3.  Regarding annual child sexual abuse reports, pursuant to Sec-
 37    tion 67-1405, Idaho Code,  the  Office  of  the  Attorney  General  is  hereby
 38    directed  to  pay  the associated costs for publishing this annual report from
 39    appropriations made to the Attorney General for the Special Litigation Program
 40    for the period July 1, 2008, through June 30, 2009.

  1        SECTION 4.  There is hereby reappropriated to the Office of  the  Attorney
  2    General for Special Litigation, subject to the provisions of Section 5 of this
  3    act,  the unexpended and unencumbered balance of General Fund moneys as appro-
  4    priated for Special Litigation for fiscal year 2008, to be used for  nonrecur-
  5    ring expenditures, for the period July 1, 2008, through June 30, 2009.

  6        SECTION  5.  The reappropriation for the General Fund granted in Section 4
  7    of this act shall be subject to the following provisions:
  8        (1)  If the unexpended and unencumbered balance in  the  General  Fund  on
  9        June  30,  2008, is zero, the reappropriation for the General Fund in Sec-
 10        tion 4 of this act is hereby declared to be null and void.
 11        (2)  If the unexpended and unencumbered balance in  the  General  Fund  on
 12        June  30, 2008, is greater than zero, but less than the total General Fund
 13        reappropriation authority granted to all state agencies, that amount reap-
 14        propriated in Section 4 of this act shall be in the  proportion  that  the
 15        reappropriation  of  the Office of the Attorney General bears to the total
 16        General Fund reappropriation authority granted to all state agencies.
