                                    SENATE BILL NO. 1464

                                    BY FINANCE COMMITTEE

  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE OFFICE OF THE STATE APPELLATE PUBLIC DEFENDER  FOR
  3        FISCAL  YEAR 2009; AND LIMITING THE NUMBER OF AUTHORIZED FULL-TIME EQUIVA-
  4        LENT POSITIONS.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  There is hereby appropriated to the Office of the State Appel-
  7    late Public Defender the following amounts to be  expended  according  to  the
  8    designated  expense  classes from the listed fund for the period July 1, 2008,
  9    through June 30, 2009:

 11    Personnel Costs                                                     $1,614,100
 12    Operating Expenditures                                                 704,400
 13      TOTAL                                                             $2,318,500
 14    FROM:
 15    General Fund                                                        $2,318,500

 16        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the Office  of
 17    the State Appellate Public Defender is authorized no more than twenty-one (21)
 18    full-time  equivalent  positions  at any point during the period July 1, 2008,
 19    through June 30, 2009, for the program specified in Section  1  of  this  act,
 20    unless   specifically   authorized   by   the  Governor.  The  Joint  Finance-
 21    Appropriations Committee will be notified promptly of any increased  positions
 22    so authorized.
