                                    SENATE BILL NO. 1469

                                    BY FINANCE COMMITTEE

  1                                        AN ACT
  2    APPROPRIATING MONEYS FROM THE IDAHO MILLENNIUM INCOME FUND AND  DIRECTING  THE
  3        STATE  CONTROLLER  TO TRANSFER MONEYS FOR THE PURPOSES AND PROGRAMS SPECI-
  4        FIED FOR FISCAL YEAR 2009; APPROPRIATING MONEYS FROM THE IDAHO  MILLENNIUM
  5        INCOME FUND TO THE STATE TREASURER FOR THE PURPOSES AND PROGRAMS SPECIFIED
  6        FOR  FISCAL  YEAR 2009; AND PROVIDING THAT CERTAIN UNEXPENDED AND UNENCUM-
  7        BERED MONEYS SHALL BE REVERTED TO THE IDAHO MILLENNIUM INCOME FUND.

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION 1.  There is hereby  appropriated  and  the  State  Controller  is
 10    hereby  directed  to make cash transfers from the Idaho Millennium Income Fund
 11    to the following programs, at the request  of  the  State  Treasurer,  not  to
 12    exceed $2,495,100 for the period July 1, 2008, through June 30, 2009:

 13        (a)  $500,000 for the Public Health Districts to continue tobacco use ces-
 14        sation programs statewide through the Public Health Districts of Idaho and
 15        other  nonprofit entities such as hospitals, primary care clinics and vol-
 16        untary organizations. The tobacco use cessation programs should be  avail-
 17        able  to  any  Idaho  citizen, with primary emphasis on youth and pregnant
 18        women.

 19        (b)  $750,000 for the Physical Health Services Program in  the  Department
 20        of  Health  and  Welfare  for targeted tobacco counter-marketing programs,
 21        specific to Idaho, and to be matched by private industry funds on at least
 22        a one-to-one basis.

 23        (c)  $700,000 for the Physical Health Services Program in  the  Department
 24        of  Health and Welfare. It is legislative intent that these funds shall be
 25        designated for nicotine replacement therapy, and that  these  funds  shall
 26        not  be used for local programs identified in the department's application
 27        proposal since they may duplicate other programs funded by the  Millennium
 28        Income Fund.

 29        (d)  $420,000  for the Idaho Supreme Court for its youth courts and status
 30        offender services programs as they relate  to  addressing  tobacco  and/or
 31        substance abuse issues.

 32        (e)  $94,000  for  Law  Enforcement  Programs in the Idaho State Police to
 33        offset the cost of youth tobacco investigations.

 34        (f)  $31,100 to the Substance Abuse Prevention and  Treatment  Program  in
 35        the Department of Health and Welfare for the Idaho Regional Drug Awareness
 36        Resource  (RADAR)  Network Center for dissemination of informational mate-
 37        rials on drug and tobacco use prevention and cessation.

  1        SECTION 2.  There is hereby appropriated from the Idaho Millennium  Income
  2    Fund  to the State Treasurer $1,674,800 to be expended for trustee and benefit
  3    payments for the following programs for the period July 1, 2008, through  June
  4    30, 2009:

  5        (a)  $170,300 for the American Lung Association of Idaho for Teens Against
  6        Tobacco Use (T.A.T.U.) and Not-On-Tobacco (N-O-T) Programs.

  7        (b)  $68,700 for the Boys and Girls Clubs of Idaho for the Positive Action
  8        Program.

  9        (c)  $141,500 for Idaho Drug Free Youth for the i2i Program.

 10        (d)  $94,200  for  Drug Free Idaho, Inc. for the Parents and Youth Against
 11        Drug Abuse (PAYADA) Program.

 12        (e)  $1,000,000 for Idaho Meth Project for a drug  prevention  media  cam-
 13        paign.

 14        (f)  $200,100  for  Easter  Seals-Goodwill Northern Rocky Mountain for the
 15        Women's Re-entry Initiative.

 16        SECTION 3.  Notwithstanding any other provision of law to the contrary, on
 17    June 30, 2009, any remaining unexpended and unencumbered  moneys  appropriated
 18    in  Section  1  of  this  act shall be reverted to the Idaho Millennium Income
 19    Fund. The State Controller shall then transfer said reverted  moneys  and  all
 20    earnings  credited to the Idaho Millennium Income Fund to the Idaho Millennium
 21    Fund.

The FY 2008 original appropriation amount only reflects moneys appropriated to non-governmental organizations. In order to avoid double counting the money, Millennium Fund moneys appropriated to state agencies are transferred by the State Controller from the Millennium Fund to the agency, and the amount is then reflected in each individual agency budget. The total amount actually appropriated from the Millennium Fund in FY 2008 was $2,533,600.
