$12,662,600 to the State Board of Education and the Board of Regents of the
University of Idaho for Special Programs, including the Forest Utilization
Research Program, Idaho Geological Survey Program, Scholarships and Grants
Program, Idaho Museum of Natural History, Idaho Small Business Development
Centers, and the Idaho Council on Economic Education for fiscal year 2009;
limits the number of full-time equivalent positions to 34.40;
reappropriates certain unexpended and unencumbered fund balances; and
appropriates $10,000,000 to the Opportunity Scholarship Program Account.

  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR SPECIAL PROGRAMS FOR FISCAL YEAR 2009;  LIMITING  THE
  3        NUMBER  OF  FULL-TIME  EQUIVALENT POSITIONS; REAPPROPRIATING CERTAIN UNEX-
  4        PENDED AND UNENCUMBERED BALANCES FOR THE SEVERAL DESIGNATED PROGRAMS; SET-
  5        TING CONDITIONS FOR REAPPROPRIATION; AND DIRECTING THE STATE CONTROLLER TO
  6        TRANSFER MONEYS TO THE OPPORTUNITY SCHOLARSHIP PROGRAM ACCOUNT.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION 1.  There is hereby appropriated to the Board of  Regents  of  the
  9    University  of Idaho and the State Board of Education for Special Programs the
 10    following amounts to be expended for the designated programs according to  the
 11    designated  expense classes from the listed funds for the period July 1, 2008,
 12    through June 30, 2009:

  1        SECTION 2.  In accordance with  Section  67-3519,  Idaho  Code,  there  is
  2    hereby  authorized no more than thirty-four and forty hundredths (34.40) full-
  3    time equivalent positions at any point during the period July 1, 2008, through
  4    June 30, 2009, for the Forest Utilization Research Program,  Idaho  Geological
  5    Survey  Program,  the Idaho Museum of Natural History, Small Business Develop-
  6    ment Centers, and TechHelp as specified in Section 1 of this act, unless  spe-
  7    cifically authorized by the Governor. The Joint Finance-Appropriations Commit-
  8    tee will be notified promptly of any increased positions so authorized.

  9        SECTION 3.  There is hereby reappropriated to the State Board of Education
 10    for the Scholarships and Grants Program, Idaho Small Business Development Cen-
 11    ters  Program, and TechHelp Program, subject to the provisions of Section 4 of
 12    this act, the unexpended and unencumbered balance of  any  appropriation  con-
 13    tained  in  Section  1, Chapter 207, Laws of 2007, to be used for nonrecurring
 14    expenditures, for the period July 1, 2008, through June 30, 2009.

 15        SECTION 4.  The reappropriation for the General  Fund  moneys  granted  in
 16    Section 3 of this act shall be subject to the following provisions:
 17        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
 18    June 30, 2008, is zero, the reappropriation for the  General  Fund  moneys  in
 19    Section 3 is hereby declared to be null and void.
 20        (2)  If  the  unexpended  and  unencumbered balance in the General Fund on
 21    June 30, 2008, is greater than zero but less than the total General  Fund  re-
 22    appropriation authority granted to all state agencies, that amount reappropri-
 23    ated in Section 3 of this act shall be in the proportion that the reappropria-
 24    tion for the State Board of Education bears to the total General Fund reappro-
 25    priation authority granted to all state agencies.

 26        SECTION  5.  There  is  hereby appropriated and the State Controller shall
 27    transfer, on July 1, 2008, or as soon thereafter as practicable, the amount of
 28    $10,000,000 from the General  Fund  to  the  Opportunity  Scholarship  Program
 29    Account for the period July 1, 2008, through June 30, 2009.
