]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1487 BY FINANCE COMMITTEE 1 AN ACT 2 RELATING TO APPROPRIATIONS; AMENDING SECTION 61-215, IDAHO CODE, TO PROVIDE 3 FOR AN INCREASE IN SALARY FOR MEMBERS OF THE PUBLIC UTILITIES COMMISSION; 4 AMENDING SECTION 63-102, IDAHO CODE, TO PROVIDE FOR AN INCREASE IN SALARY 5 FOR MEMBERS OF THE STATE TAX COMMISSION; AMENDING SECTION 72-503, IDAHO 6 CODE, TO PROVIDE FOR AN INCREASE IN SALARY FOR MEMBERS OF THE INDUSTRIAL 7 COMMISSION; APPROPRIATING ADDITIONAL MONEYS TO THE PUBLIC UTILITIES COM- 8 MISSION FOR COMMISSIONER SALARIES FOR FISCAL YEAR 2009; APPROPRIATING 9 ADDITIONAL MONEYS TO THE STATE TAX COMMISSION FOR COMMISSIONER SALARIES 10 FOR FISCAL YEAR 2009; AND APPROPRIATING ADDITIONAL MONEYS TO THE INDUS- 11 TRIAL COMMISSION FOR COMMISSIONER SALARIES FOR FISCAL YEAR 2009. 12 Be It Enacted by the Legislature of the State of Idaho: 13 SECTION 1. That Section 61-215, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 61-215. SALARIES OF PUBLIC UTILITIES COMMISSIONERS. Each member of the 16 public utilities commission shall devote full time to the performance of 17 his/her duties. Commencing on July 1, 20078, the annual salary of members of 18 the public utilities commission shall beeighty-nineninety-two thousandfour19 one hundredeighty-threesixty-seven dollars ($89,48392,167) and shall be paid 20 from sources set by the legislature. 21 SECTION 2. That Section 63-102, Idaho Code, be, and the same is hereby 22 amended to read as follows: 23 63-102. ORGANIZATION -- CHAIRMAN -- COMPENSATION -- QUORUM -- HEARINGS. 24 (1) A member of the state tax commission shall be appointed by the governor, 25 to serve at his pleasure, as chairman. Each member of the state tax commission 26 shall devote full time to the performance of duties. Commencing on July 1, 27 20078, the annual salary for members of the state tax commission shall be 28 eighty-twofive thousandninefour hundredfifty-nineforty-seven dollars 29 ($82,95985,447). 30 (2) A majority of the state tax commission shall constitute a quorum for 31 the transaction of business. The state tax commission may delegate to any mem- 32 ber of the commission or to its employees, the power to make investigations 33 and hold hearings at any place it may deem proper, and such other matters as 34 will facilitate the operations of the commission. 35 (3) The chairman of the state tax commission shall delegate to each com- 36 missioner the responsibility for policy management and oversight of one (1) or 37 more of the taxes collected and/or activities supervised or administered by 38 the commission. The state tax commission shall perform the duties imposed upon 39 it by law and shall adopt all rules by majority decision. 40 In any case in which the state tax commission sits as an appellate body 41 upon an appeal from a tax decision from one (1) of the various administrative 2 1 units subject to its supervision, the state tax commissioner charged with 2 responsibility for policy management and oversight of the tax in controversy 3 shall not vote upon the appeal but may advise the remaining members of the 4 commission on the technical aspects of the problems before them. 5 (4) The chairman shall be the chief executive officer and administrative 6 head of the state tax commission and shall be responsible for, or may assign 7 responsibility for, all personnel, budgetary and/or fiscal matters of the 8 state tax commission. 9 SECTION 3. That Section 72-503, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 72-503. SALARY. Commencing July 1, 20078, the annual salary of each mem- 12 ber of the industrial commission shall be eighty-sevennine thousandninety-13nineseven hundred eleven dollars ($87,09989,711). Industrial commissioner 14 salaries shall be paid from sources set by the legislature. Each member of the 15 industrial commission shall devote full time to the performance of his duties. 16 SECTION 4. In addition to any other appropriation made by law, there is 17 hereby appropriated to the Public Utilities Commission, the following amount 18 to be expended for commissioner salaries and benefit costs according to the 19 designated expense class from the listed fund for the period July 1, 2008, 20 through June 30, 2009: 21 FOR: 22 Personnel Costs $9,700 23 FROM: 24 Public Utilities Commission Fund $9,700 25 SECTION 5. In addition to any other appropriation made by law, there is 26 hereby appropriated to the State Tax Commission in the Department of Revenue 27 and Taxation the following amounts to be expended for commissioner salaries 28 and benefits within the designated programs according to the designated 29 expense class from the listed funds for the period July 1, 2008, through June 30 30, 2009: 31 I. GENERAL SERVICES: 32 FOR: 33 Personnel Costs $11,000 34 FROM: 35 General Fund $10,100 36 Administration Services for Transportation Fund 900 37 TOTAL $11,000 38 II. This legislation provides for a three percent (3%) increase in the annual salary of each of the Industrial Commissioners, State Tax Commissioners, and Public Utilities Commissioners, effective July 1, 2008. The salary of each of the three Industrial Commissioners is raised from $87,099 to $89,711. The salary of each of the four Tax Commissioners is raised from $82,959 to $85,447. The salary of each of the three Public Utilities Commissioners is raised from $89,483 to $92,167.

The fiscal impact to the General Fund is $10,100 for a portion of the increase in annual salaries for the State Tax Commissioners. The remaining $2,000 of the salary increase for the State Tax Commissioners will be paid from dedicated funds. The total cost of $9,500 for the Industrial Commissioners’ salary increase and $9,700 for the Public Utilities Commissioners’ salary increase will be paid from dedicated funds. This calculation of fiscal impact includes salary plus variable benefits costs. The total fiscal impact is $10,100 in General Fund monies and $21,200 in dedicated funds for a total of $31,300.
