                                    SENATE BILL NO. 1496

  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE IDAHO SCHOOL FOR THE DEAF AND THE BLIND FOR  FIS-
  3        CAL  YEAR  2009;  LIMITING  THE  NUMBER OF FULL-TIME EQUIVALENT POSITIONS;
  4        AUTHORIZING FUND DEPOSITS; DIRECTING THAT THE IDAHO SCHOOL  FOR  THE  DEAF
  5        AND  THE  BLIND  ONLY  OPERATE THE NECESSARY NUMBER OF COTTAGES; DIRECTING
  6        THAT THE IDAHO SCHOOL FOR THE DEAF AND THE BLIND PROVIDE CERTAIN  INFORMA-
  7        TION  TO THE LEGISLATURE; AND DIRECTING THAT THE IDAHO SCHOOL FOR THE DEAF
  8        AND THE BLIND ENTER INTO CERTAIN AGREEMENTS WITH ENTITIES THAT USE  CAMPUS
  9        FACILITIES.

 10    Be It Enacted by the Legislature of the State of Idaho:

 11        SECTION  1.  There  is hereby appropriated to the State Board of Education
 12    for the Idaho School for the Deaf and the Blind the following  amounts  to  be
 13    expended  for  the  designated  programs  according  to the designated expense
 14    classes from the listed funds for the period July 1, 2008,  through  June  30,
 15    2009:

 35        SECTION  2.  In  accordance  with  Section  67-3519, Idaho Code, the Idaho
 36    School for the Deaf and the Blind is authorized no more than ninety-three  and
 37    seventy-four  hundredths  (93.74)  full-time equivalent positions at any point
 38    during the period July 1, 2008, through June  30,  2009,  unless  specifically
 39    authorized by the Governor. The Joint Finance-Appropriations Committee will be
 40    notified promptly of any increased positions so authorized.

  1        SECTION  3.  The  Idaho  School for the Deaf and the Blind may deposit any
  2    funds appropriated by Section 1, Chapter 324, Laws of 2007, in  a  contingency
  3    reserve fund created pursuant to Section 33-3409, Idaho Code.

  4        SECTION  4.  The Idaho School for the Deaf and the Blind shall not operate
  5    any residential cottages  beyond  those  necessary  to  provide  single-gender
  6    accommodations  for  students attending from locations that are too distant to
  7    participate in the campus day program. If an additional cottage is  necessary,
  8    the  Idaho  School  for the Deaf and the Blind shall report to the Legislature
  9    the justification and costs for the additional cottage. Additionally, priority
 10    for placement of students into cottages shall be for those students under  the
 11    age  of  18  years and the Idaho School for the Deaf and the Blind staff shall
 12    actively seek community placement for students 18 years of age and older.

 13        SECTION 5.  To better understand  the  student  population  at  the  Idaho
 14    School  for the Deaf and the Blind, the school shall report to the Legislature
 15    no later than September 30, 2008, the following information by  student:  age,
 16    gender,  physical  disability, any mental health diagnosis, any cognitive dis-
 17    ability, home region, and current admittance  qualifications  to  the  school.
 18    Student names shall be excluded from the information provided.

 19        SECTION  6.  The  Idaho School for the Deaf and the Blind shall enter into
 20    an agreement, including a schedule of fees, to  cover  the  costs  of  general
 21    maintenance and utilities, with entities that use campus facilities on a regu-
 22    lar or ongoing basis.
