  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE DIVISION OF HUMAN RESOURCES FOR FISCAL YEAR  2009;
  3        LIMITING  THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS; DIRECT-
  4        ING THE COLLECTION OF CERTAIN FEES BY THE DIVISION OF HUMAN RESOURCES  FOR
  5        AGENCIES  NOT  OPERATING  UNDER A DELEGATED AUTHORITY MEMORANDUM OF UNDER-
  6        STANDING; DIRECTING THE COLLECTION OF CERTAIN  FEES  BY  THE  DIVISION  OF
  7        HUMAN  RESOURCES  FOR AGENCIES OPERATING UNDER A DELEGATED AUTHORITY MEMO-
  8        RANDUM OF UNDERSTANDING; DIRECTING THE PAYMENT  FOR  STATEWIDE  MANAGEMENT
  9        AND  HUMAN  RESOURCES  TRAINING  TO THE DIVISION OF PROFESSIONAL-TECHNICAL
 10        EDUCATION.

 11    Be It Enacted by the Legislature of the State of Idaho:

 12        SECTION 1.  There is hereby appropriated to the Office of the Governor for
 13    the Division of Human Resources the following amount to be expended  according
 14    to  the designated expense classes from the listed fund for the period July 1,
 15    2008, through June 30, 2009:

 24        SECTION 2.  In accordance with Section 67-3519, Idaho Code,  the  Division
 25    of  Human Resources is authorized no more than eighteen (18) full-time equiva-
 26    lent positions at any point during the period July 1, 2008, through  June  30,
 27    2009,  for the program specified in Section 1 of this act, unless specifically
 28    authorized by the Governor. The Joint Finance-Appropriations Committee will be
 29    notified promptly of any increased positions so authorized.

 30        SECTION 3.  For all state agencies that are not operating  under  a  dele-
 31    gated  authority  memorandum of understanding, the Division of Human Resources
 32    shall collect the full amount of fees that are included in the personnel costs
 33    for participating agencies in accordance with the methodology provided in sec-
 34    tion 67-5314(2), Idaho Code, for the period July 1,  2008,  through  June  30,
 35    2009.

 36        SECTION  4.  Notwithstanding  Section 67-5314(2), Idaho Code, for agencies
 37    that operate under a delegated  authority  memorandum  of  understanding,  the
 38    Division  of Human Resources shall collect a reduced fee of 0.00340 multiplied
 39    by the total amount of payroll for classified  employees  by  agency  for  the
 40    period July 1, 2008, through June 30, 2009.

  1        SECTION 5.  Of the amount appropriated in Section 1 of this act, the Divi-
  2    sion  of  Human  Resources  shall pay from operating expenditures, through the
  3    state interagency billing process, to the Division  of  Professional-Technical
  4    Education  up  to  $208,900 for the cost of providing statewide management and
  5    human resources training.
