                            SENATE CONCURRENT RESOLUTION NO. 126

                              BY HEALTH AND WELFARE COMMITTEE

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF THE DEPART-
  3        MENT OF HEALTH AND WELFARE PERTAINING TO RULES GOVERNING TEMPORARY  ASSIS-
  4        TANCE FOR FAMILIES IN IDAHO.

  5    Be It Resolved by the Legislature of the State of Idaho:

  6        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  8    that the Legislature finds that the rules are not consistent with  legislative
  9    intent; and
 10        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
 11    Department of Health and  Welfare  pertaining  to  Rules  Governing  Temporary
 12    Assistance  for  Families  in Idaho are not consistent with legislative intent
 13    and should be rejected.
 14        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 15    sion  of the Fifty-ninth Idaho Legislature, the Senate and the House of Repre-
 16    sentatives concurring therein, that IDAPA 16.03.08, Department of  Health  and
 17    Welfare,  Rules  Governing Temporary Assistance for Families in Idaho, adopted
 18    as pending rules under  Docket  Number  16-0308-0701,  the  entire  rulemaking
 19    docket,  be, and the same is hereby rejected and declared null, void and of no
 20    force and effect.

Statement of Purpose / Fiscal Impact


                   STATEMENT OF PURPOSE

This concurrent resolution would reject a pending rule of the
Department of Health and Welfare pertaining to the Rules
Governing Temporary Assistance for Families in Idaho.  The effect
of this resolution, if adopted by both houses, would be to
prevent the agency rule from going into effect.



                          FISCAL NOTE

This concurrent resolution has no fiscal impact.
