                            SENATE CONCURRENT RESOLUTION NO. 131

                              BY JUDICIARY AND RULES COMMITTEE

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF  THE  REAL
  3        ESTATE COMMISSION RELATING TO RULES OF THE IDAHO REAL ESTATE COMMISSION.

  4    Be It Resolved by the Legislature of the State of Idaho:

  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 10    Real Estate Commission relating to Rules of the Idaho Real  Estate  Commission
 11    is not consistent with legislative intent and should be rejected.
 12        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 13    sion of the Fifty-ninth Idaho Legislature, the Senate and the House of  Repre-
 14    sentatives  concurring  therein,  that IDAPA 33.01.01, Rules of the Idaho Real
 15    Estate Commission, Section 500, Minimum Teaching Standards of the  Commission,
 16    Subsection   08,   only,  adopted  as  a  pending  rule  under  Docket  Number
 17    33-0101-0702, Idaho Real  Estate  Commission,  be,  and  the  same  is  hereby
 18    rejected and declared null, void and of no force and effect.

                      STATEMENT OF PURPOSE
                                
                            RS17941 


This concurrent resolution would reject a subsection of a pending
rule of the Idaho Real Estate Commission relating to the Rules of
the Idaho Real Estate Commission.  The effect of this resolution,
if adopted by both houses, would be to prevent the language in a
subsection of the agency rule as amended from going into effect.

This concurrent resolution has no fiscal impact.
