                               SENATE JOINT MEMORIAL NO. 109

                                   BY EDUCATION COMMITTEE

  1                                   A JOINT MEMORIAL
  2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
  3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
  4        IDAHO IN THE CONGRESS OF THE UNITED STATES.

  5        We, your Memorialists, the Senate and the House of Representatives of  the
  6    State  of  Idaho  assembled  in  the Second Regular Session of the Fifty-ninth
  7    Idaho Legislature, do hereby respectfully represent that:

  8        WHEREAS, the Maintenance of Effort (MOE) provision in Section 108  of  the
  9    College  Opportunity  and Affordability Act of 2007 (H.R. 4137) now before the
 10    United States House of Representatives would punish states for not maintaining
 11    or increasing higher education funding appropriations; and
 12        WHEREAS, this would place the federal government in charge of  determining
 13    when state legislatures and governors have adequately funded higher education;
 14    and
 15        WHEREAS,  this mandate in higher education would set a dangerous precedent
 16    for federal intrusion into state policy and appropriations authority; and
 17        WHEREAS, state legislators are also concerned  with  the  rising  cost  of
 18    higher  education  and are committed to making higher education affordable for
 19    all citizens; and
 20        WHEREAS, state budgeting decisions should be made by state officials,  not
 21    the United States Secretary of Education.
 22        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 23    sion of the Fifty-ninth Idaho Legislature, the Senate and the House of  Repre-
 24    sentatives  concurring  therein,  that Congress should strike Section 108 from
 25    the College Opportunity and Affordability Act of 2007 (H.R. 4137) before send-
 26    ing the final bill to the President of the United States to sign into law.
 27        BE IT FURTHER RESOLVED that the Secretary of the Senate  be,  and  she  is
 28    hereby authorized and directed to forward a copy of this Memorial to the Pres-
 29    ident  of  the  Senate and the Speaker of the House of Representatives of Con-
 30    gress, and the congressional delegation representing the State of Idaho in the
 31    Congress of the United States.
