]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 404 BY RESOURCES AND CONSERVATION COMMITTEE 1 AN ACT 2 RELATING TO WATER; REPEALING SECTION 42-620, IDAHO CODE, RELATING TO CERTAIN 3 WATER DISTRICT EXPENSES; AND AMENDING CHAPTER 17, TITLE 42, IDAHO CODE, BY 4 THE ADDITION OF A NEW SECTION 42-1779, IDAHO CODE, TO PROVIDE FOR THE 5 TRANSFER OF SPECIFIED SUMS TO DESIGNATED ACCOUNTS FOR USE IN A STATEWIDE 6 COMPREHENSIVE AQUIFER PLANNING AND MANAGEMENT EFFORT. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 42-620, Idaho Code, be, and the same is hereby 9 repealed. 10 SECTION 2. That Chapter 17, Title 42, Idaho Code, be, and the same is 11 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 12 ignated as Section 42-1779, Idaho Code, and to read as follows: 13 42-1779. STATEWIDE COMPREHENSIVE AQUIFER PLANNING AND MANAGEMENT EFFORT. 14 Pursuant to the provisions of Idaho law and legislative funding approval, the 15 Idaho water resource board and the Idaho department of water resources shall 16 conduct a statewide comprehensive aquifer planning and management effort over 17 a ten (10) year period of time beginning in fiscal year 2009. The sum of eigh- 18 teen million four hundred thousand dollars ($18,400,000) shall be transferred 19 from the general fund to the continuously appropriated water resource board 20 revolving development fund to be used for technical studies, facilitation ser- 21 vices, hydrologic monitoring, measurement and comprehensive plan development 22 associated with the aquifer planning and management effort. An additional 23 amount of one million six hundred thousand dollars ($1,600,000) shall be 24 transferred from the general fund to the water administration fund for person- 25 nel costs, operating expenses and capital outlay associated with the aquifer 26 planning and management effort.
STATEMENT OF PURPOSE RS 17644 The purpose of Section 1 of this legislation is to repeal Section 42-620, Idaho Code, that requires assessments to be made to all water users of water hydraulically connected to the Eastern Snake Plain Aquifer to be collected by the Department of Water Resources. The funding of the completion of the planning effort underway for the ESPA is provided in new Section 42-1779. New Section 42-1779, provides for a statewide comprehensive aquifer planning and management effort over a ten year period, beginning in fiscal year 2009, to include all aquifers of the state, to be funded by the state. $18,400,000 to be transferred to the continuously appropriated water resource board revolving development fund for planning and management efforts, and $1 ,600.000 to be transferred to the water resources administration fund for personnel costs, operating expenses and capital outlay associated with the aquifer planning and management effort.
