  1                                        AN ACT
  2    RELATING TO THE IDAHO  FOOD  QUALITY  ASSURANCE  INSTITUTE;  AMENDING  SECTION
  3        67-8302,  IDAHO CODE, TO REVISE MEMBERSHIP PROVISIONS RELATING TO THE COM-
  4        MISSIONERS OF THE IDAHO FOOD QUALITY ASSURANCE  INSTITUTE  AND  TO  DELETE
  5        OBSOLETE VERBIAGE.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That  Section 67-8302, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

  9        67-8302.  COMMISSIONERS -- CHAIRMAN -- APPOINTMENTS.  The  governor  shall
 10    appoint  ten (10) persons to be commissioners of the Idaho food quality assur-
 11    ance institute. The commissioners shall serve at the pleasure of the  governor
 12    and shall include the following:
 13        (1)  One (1) representative of a row crop commodity commission industry;
 14        (2)  One (1) representative of an orchard commodity commission industry;
 15        (3)  One (1) representative of a grain commodity commission industry;
 16        (4)  One  (1)  representative  of  a  specialty  commodity commission crop
 17    industry;
 18        (5)  One (1) representative of an animal product  commodity  commission  a
 19    livestock industry;
 20        (6)  One (1) consumer;
 21        (7)  One (1) representative of the Idaho department of agriculture;
 22        (8)  One (1) representative of the college of southern Idaho;
 23        (9)  One  (1) scientist with practical experience in quality certification
 24    procedures and standards;
 25        (10) One (1) representative of the private laboratory industry.
 26        The governor shall appoint a chairman from among the nine (9)  commission-
 27    ers.  The commissioners shall be appointed for terms of four (4) years, except
 28    that all vacancies shall be filled for the unexpired term.  The terms  of  the
 29    first  nine (9) commissioners shall end on July 1, 2000; the terms of four (4)
 30    of the commissioners next appointed shall end on July 1, 2002, and  the  terms
 31    of  the  remaining  five (5) commissioners next appointed shall end on July 1,
 32    2004. A commissioner shall hold office until a successor  has  been  appointed
 33    and  qualifies.  A certificate of the appointment or reappointment of any com-
 34    missioner shall be filed in the office of the secretary of state  and  in  the
 35    office  of  the institute, and the certificate shall be conclusive evidence of
 36    the due and proper appointment of the commissioner.  The governor,  the  state
 37    treasurer,  the  state  controller  and  the  administrator of the division of
 38    financial management shall serve as  advisors  to  the  commissioners  of  the
 39    institute.
 40        In  addition, two (2) members of the Idaho senate, one (1) from the major-
 41    ity party and one (1) from the minority party, and  two  (2)  members  of  the
 42    Idaho  house  of  representatives, one (1) from the majority party and one (1)
 43    from the minority party, may be appointed by the legislative council to  serve

  1    as advisors to the commissioners of the institute.  Such appointments shall be
  2    for  a term of two (2) years beginning on January 1 of each odd-numbered year,
  3    and no appointee shall serve more than two (2)  terms.  Actual  and  necessary
  4    expenses and per diem shall be allowed to the legislative advisors as provided
  5    for  members  of  the  legislative council, and shall be paid from legislative
  6    funds.

*The purpose of this legislation is to make changes in terminology of
the representatives serving on the Idaho Food Quality Assurance
Institute. The original legislation called for "commission members" to
be appointed to the institute. Some of the organizations being
represented on the institute do not have commissions. The changes will
allow for broader representation.
