]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 532 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO SCHOOL FUNDING; STATING FINDINGS OF THE LEGISLATURE; AND AMENDING 3 CHAPTER 9, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-910, 4 IDAHO CODE, TO PROVIDE STATE FUNDING TO TEMPORARILY MITIGATE THE IMPACT ON 5 CERTAIN IDAHO SCHOOL DISTRICTS FOR LOSS OF FEDERAL FUNDS PREVIOUSLY AUTHO- 6 RIZED UNDER THE SECURE RURAL SCHOOLS AND COMMUNITY SELF-DETERMINATION ACT, 7 PUBLIC LAW 106-393 AND TO PROVIDE FOR RETURN OF STATE MONEYS TO THE PUBLIC 8 EDUCATION STABILIZATION FUND IF FEDERAL MONEYS ARE RECEIVED; PROVIDING AN 9 EFFECTIVE DATE AND PROVIDING A SUNSET DATE. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. It is the finding of the Legislature that there remains uncer- 12 tainty in the reauthorization of the federal Secure Rural Schools and Commu- 13 nity Self-Determination Act by the Congress of the United States. If the fed- 14 eral government has not reauthorized the Secure Rural Schools and Community 15 Self-Determination Act, Public Law 106-393, or substantially similar legisla- 16 tion, it will have negative effects on certain Idaho school districts and in 17 this case the Legislature is prepared to temporarily mitigate the impact on 18 those Idaho school districts and to offset the loss of federal funds previ- 19 ously authorized under the Secure Rural Schools and Community Self- 20 Determination Act, Public Law 106-393. 21 SECTION 2. That Chapter 9, Title 33, Idaho Code, be, and the same is 22 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 23 ignated as Section 33-910, Idaho Code, and to read as follows: 24 33-910. SECURE RURAL SCHOOLS AND COMMUNITY SELF-DETERMINATION ACT PHASE 25 OUT FUNDING. (1) If the state superintendent of public instruction determines 26 that the federal government has not reauthorized the secure rural schools and 27 community self-determination act of 2000, public law 106-393, or substantially 28 similar legislation, by February 10, 2009, the legislature shall appropriate 29 from the public education stabilization fund to the state superintendent of 30 public instruction for distribution to eligible school districts an amount 31 that is equal to seventy percent (70%) of the distribution made to school dis- 32 tricts in December 2007 by eligible counties under title I, public law 33 106-393. The distributions to eligible school districts shall be based on the 34 same proportion of the total that each school district received during the 35 December 2007 distribution made to school districts by eligible counties under 36 title I, public law 106-393. 37 (2) For each following fiscal year that the state superintendent of pub- 38 lic instruction determines that the federal government has not reauthorized 39 the secure rural schools and community self-determination act of 2000, public 40 law 106-393, or substantially similar legislation, by February 10 of that 41 year, the state shall appropriate from the public education stabilization 42 fund: 2 1 (a) For fiscal year 2010, an amount that is equal to fifty-five percent 2 (55%) of the distribution made to school districts in December 2007 by 3 eligible counties under title I, public law 106-393. 4 (b) For fiscal year 2011, an amount that is equal to forty percent (40%) 5 of the distribution made to school districts in December 2007 by eligible 6 counties under title I, public law 106-393. 7 (c) For fiscal year 2012, an amount that is equal to twenty-five percent 8 (25%) of the distribution made to school districts in December 2007 by 9 eligible counties under title I, public law 106-393. 10 (d) For fiscal year 2013, there shall be no funding under the provisions 11 of this section. 12 (3) If the superintendent of public instruction determines that the fed- 13 eral government has reauthorized the secure rural schools and community self- 14 determination act of 2000, public law 106-393, or substantially similar legis- 15 lation, after February 10, 2009, and that the first payment to school dis- 16 tricts shall take place on or prior to July 15, 2009, then each school dis- 17 trict shall return all state moneys distributed pursuant to this section for 18 deposit to the public education stabilization fund, up to a maximum of the 19 amount of federal money so received. 20 (4) If the superintendent of public instruction determines that the fed- 21 eral government has reauthorized the secure rural schools and community self- 22 determination act of 2000, public law 106-393, or substantially similar legis- 23 lation, after February 10 of any fiscal year after 2009, and that the first 24 payment to school districts shall take place on or prior to July 15 of that 25 year, then each school district shall return all state moneys distributed in 26 that fiscal year pursuant to this section for deposit to the public education 27 stabilization fund, up to a maximum of the amount of federal money so 28 received. 29 SECTION 3. This act shall be in full force and effect on and after July 30 1, 2008, and shall be of no force and effect on and after July 1, 2012.
REPRINT REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS 17876 The proposed legislation would amend Chapter 9, Title 33, Idaho Code to provide state funding from the Public Education Stabilization Fund to temporarily mitigate the impact on certain Idaho school districts for loss of Secure Rural Schools and Community Self-Depreciation Act federal funds. If the Superintendent of Public Instruction determines that the federal government has reauthorized the Secure Rural Schools and Self- Determination Act, these funds will not be distributed. FISCAL NOTE The fiscal impact will be based on the distribution made by the federal government for secure schools funding as of December, 2007, of $6,176,258.88. For December, 2008, the amount of state funding would be seventy percent (70%)or $4,323,381.22; December, 2009, the amount of state funding would be fifty-five percent (55%)or $3,396,942.38; December, 2010, the amount of state funding would be forty percent (40%)or $2,470,503.55; and December, 2011, the amount of state funding would be twenty-five percent (25%)or $1,544,064.72.
