  1                                        AN ACT
  2    RELATING TO ALCOHOLIC BEVERAGES; AMENDING TITLE 23, IDAHO CODE, BY  THE  ADDI-
  3        TION  OF  A  NEW CHAPTER 15, TITLE 23, IDAHO CODE, TO PROVIDE THAT CERTAIN
  4        PERSONS SHALL COMPLETE AN ALCOHOL RECOGNITION AND TRAINING PROGRAM  WITHIN
  5        A SPECIFIED PERIOD OF TIME, TO PROVIDE THAT LICENSEES SHALL MAINTAIN DOCU-
  6        MENTATION  OF  TRAINING  AND PROVIDE THE DOCUMENTATION UPON REQUEST TO THE
  7        IDAHO STATE POLICE AND TO PROVIDE PENALTIES.

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION 1.  That Title 23, Idaho Code, be, and the same is hereby  amended
 10    by  the addition thereto of a NEW CHAPTER, to be known and designated as Chap-
 11    ter 15, Title 23, Idaho Code, and to read as follows:

 12                                      CHAPTER 15
 13                       ALCOHOL RECOGNITION AND TRAINING PROGRAM

 14        23-1501.  ALCOHOL RECOGNITION AND TRAINING PROGRAM. In  order  to  further
 15    prevent  sales  of alcoholic beverages to minors, employed agents, servants or
 16    bartenders of any person licensed pursuant to  the  provisions  of  title  23,
 17    Idaho  Code,  officers,  agents  or  employees of the dispensary, and contract
 18    sales locations personnel, involved in the retail sales  of  alcoholic  bever-
 19    ages,  shall  complete  an  alcohol  recognition  and training program such as
 20    training for intervention procedures (TIPS) certification, ServSafe certifica-
 21    tion, or other equivalent program as determined by the director of  the  Idaho
 22    state police to facilitate recognition of valid age identification. Any person
 23    subject  to  this training requirement on the effective date of this act shall
 24    complete training within sixty (60) days of the effective date  of  this  act.
 25    Any  person who becomes subject to this training requirement subsequent to the
 26    effective date of this act shall  complete  the  training  requirement  within
 27    thirty  (30)  days of becoming subject to this training requirement. Licensees
 28    shall maintain documentation of such training of their employed  agents,  ser-
 29    vants or bartenders and provide such documentation at the request of the Idaho
 30    state  police.  Licensees  employing persons who have not completed an alcohol
 31    recognition and training program as provided in this section shall be  subject
 32    to  a fine in an amount not to exceed one hundred dollars ($100) for each con-
 33    tinuing day of violation. Any person who is required to  complete  an  alcohol
 34    recognition  and  training  program pursuant to the provisions of this section
 35    who has not completed such program as required shall be subject to a fine  not
 36    to exceed one hundred dollars ($100).

                       STATEMENT OF PURPOSE

                             RS 18050

The purpose of this legislation is to require mandatory training
for all retail clerks and servers of alcohol, retail sales in
state liquor stores for identification of minors to decrease
illegal purchase of alcohol. 



                           FISCAL NOTE

About $5000 for the training of liquor dispensary employees.
