]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 591 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO MANAGED CARE REFORM; AMENDING SECTION 41-3932, IDAHO CODE, TO PRO- 3 VIDE THAT THE MANAGED CARE REFORM ACT SHALL NOT APPLY TO CERTAIN PROGRAMS 4 ADMINISTERED BY THE DEPARTMENT OF HEALTH AND WELFARE AND TO PROVIDE FOR 5 RULES. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 41-3932, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 41-3932. EXEMPTIONS FROM APPLICATION OF CHAPTER. This chapter shall not 10 apply to managed care programs operated under contract with the federal gov- 11 ernment under title XVIII of the federal social security act, as amended 12 (medicare), or under contract with a plan otherwise exempt from operation of 13 this chapter pursuant to the employee retirement income security act of 1974, 14 as amended (ERISA). This chapter shall not apply to programs administered by 15 the department of health and welfare under contract with the department of 16 health and welfare under title XIX of the federal social security act, as 17 amended (medicaid) or under programs administered by the department of health 18 and welfare substance use disorder bureau or its contracted managed care orga- 19 nization. The director shall take such actions and promulgate such rules as 20 shall be necessary to effectuate the provisions of this section.

STATEMENT OF PURPOSE RS 18044C1 This proposed legislation seeks to add an exempted entity to Idaho code Title 41 chapter 3932. This is one of the first pieces of legislation being brought forward by the Interagency Committee on Substance Abuse Prevention and Treatment that addresses the legislative intent of addressing what is working and what is not working and to reduce duplication of services in the State substance abuse treatment system which is mandated in Idaho Statute 39 chapter 303 which passed in the last legislative session unanimously by both the House and Senate. This legislation would give the ability to Health and Welfare Substance use Disorder Bureau, in collaboration with the Interagency Committee on Substance Abuse Prevention and Treatment, to engage in preferred contracting with private treatment providers. Preferred contracting is currently standard practice for Medicaid PSR providers. This is for providers who wish to be reimbursed for services from the state. This does not affect providers who receive reimbursement by private pay and insurance. In addition, this legislation does not affect current network providers. Current providers fall within Health and Welfare IDAPA 16.06.03 which outlines the process to be followed for suspension or revocation of approval.
