                                    SENATE BILL NO. 1260

                              BY JUDICIARY AND RULES COMMITTEE

  1                                        AN ACT
  2    RELATING TO EXHIBITIONS OF DOGFIGHTS; AMENDING SECTION 25-3507, IDAHO CODE, TO
  3        PROVIDE THAT PERSONS WHO KNOWINGLY OR INTENTIONALLY PARTICIPATE IN CERTAIN
  4        ACTIVITIES RELATED TO DOGFIGHTING EXHIBITIONS SHALL BE GUILTY OF A  FELONY
  5        AND TO EXEMPT FROM APPLICATION CERTAIN ACTIVITIES.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That  Section 25-3507, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

  9        25-3507.  EXHIBITION OF DOGFIGHTS. (1) Every person  who  knowingly  owns,
 10    possesses,  keeps,  trains,  buys or sells dogs for the purpose of a public or
 11    private display of combat between two (2) or more dogs in which the  fighting,
 12    killing,  maiming  or injuring of dogs is a significant feature is guilty of a
 13    felony.
 14        (2)  Every person who knowingly  advertises, promotes, organizes, partici-
 15    pates or knowingly has a monetary interest in a public or private  display  of
 16    combat between two (2) or more dogs in which the fighting, killing, maiming or
 17    injuring  of  dogs  is  a  significant  feature is guilty of a misdemeanor and
 18    shall, upon conviction, be punished in accordance with section 25-3520A, Idaho
 19    Code felony.
 20        (3)  Every person who is knowingly  present as a spectator  at  any  place
 21    where  preparations  are  being made for an exhibition of the fighting of dogs
 22    with the intent to be present at such preparations or to be knowingly  present
 23    at such exhibition shall be guilty of a misdemeanor and  shall,  upon  convic-
 24    tion, be punished in accordance with section 25-3520A, Idaho Code.
 25        (4)  Nothing  in  this  section  prohibits: demonstrations of the hunting,
 26    herding, working or tracking skills of dogs or the  lawful  use  of  dogs  for
 27    hunting,  herding,  working, tracking or self and property protection; the use
 28    of dogs in the management of livestock or the training, raising,  breeding  or
 29    keeping  of  dogs  for  any  purpose  not  prohibited by law. An exhibition of
 30    dogfighting shall not be construed to mean the type of confrontation that hap-
 31    pens unintentionally because of a chance encounter between  two  (2)  or  more
 32    uncontrolled dogs.

     The amendment changes the penalty for dog fighting from a
misdemeanor to a felony.

     There will be no impact to the state's general fund.
