                                    SENATE BILL NO. 1312

  1                                        AN ACT
  2    RELATING TO QUALIFICATIONS OF  VOLUNTEERS;  AMENDING  SECTION  67-2336,  IDAHO
  3        CODE,  TO  PROVIDE FOR SELECTION OF VOLUNTEERS BY AGENCIES, DEPARTMENTS OR
  4        UNITS OF STATE GOVERNMENT.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  That Section 67-2336, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:

  8        67-2336.  QUALIFICATIONS OF VOLUNTEERS. Civil service law and requirements
  9    shall  not  apply  to  volunteers in any program conducted or sponsored by any
 10    agency, department or unit of state government.  Requirements  for  volunteers
 11    are limited to requirements set by federal statute and to any requirements set
 12    by  the  agency, department or unit of state government sponsoring the program
 13    or service. A person may not be rejected as a volunteer except for proven mis-
 14    conduct or for being convicted or found guilty of a criminal offense  in  this
 15    state,  in  another state, territory or province or by the federal government.
 16    No agency, department or unit of state government may be  required  to  accept
 17    volunteers  beyond  their need for the volunteer. Volunteer positions shall be
 18    filled on the basis  of  qualifications  and  merit.  No  volunteer  shall  be
 19    rejected on the basis of a personal conflict.
