]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1346 BY FINANCE COMMITTEE 1 AN ACT 2 RELATING TO APPROPRIATIONS AND TRANSFERS OF FUNDS; PROVIDING AN APPROPRIATION 3 AND A TRANSFER OF FUNDS TO THE FIRE SUPPRESSION DEFICIENCY FUND; PROVIDING 4 AN APPROPRIATION AND A TRANSFER OF FUNDS TO THE PEST CONTROL DEFICIENCY 5 FUND; PROVIDING AN APPROPRIATION AND A TRANSFER OF FUNDS TO THE HAZARDOUS 6 SUBSTANCE EMERGENCY RESPONSE FUND; GRANTING A CONTINUOUS APPROPRIATION FOR 7 THE BUREAU OF HOMELAND SECURITY'S MISCELLANEOUS REVENUE FUND FOR FISCAL 8 YEAR 2008; AND DECLARING AN EMERGENCY. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. There is hereby appropriated and the State Controller shall 11 transfer $21,500,000 from the General Fund to the Fire Suppression Deficiency 12 Fund. Such moneys shall be used to reimburse costs incurred by the Forest and 13 Range Fire Protection Program in the Department of Lands pursuant to Sections 14 38-131 and 38-131A, Idaho Code. 15 SECTION 2. There is hereby appropriated and the State Controller shall 16 transfer $255,000 from the General Fund to the Pest Control Deficiency Fund. 17 Such moneys shall be used to reimburse costs incurred by the Plant Industries 18 Program in the Department of Agriculture pursuant to Section 22-2019, Idaho 19 Code. 20 SECTION 3. There is hereby appropriated and the State Controller shall 21 transfer $69,300 from the General Fund to the Hazardous Substance Emergency 22 Response Fund. Such moneys shall be used to reimburse costs incurred by the 23 Bureau of Homeland Security in the Military Division of the Office of the Gov- 24 ernor pursuant to Section 39-7110, Idaho Code. 25 SECTION 4. The Military Division is hereby granted continuous appropria- 26 tion authority for the Bureau of Homeland Security's Miscellaneous Revenue 27 Fund for the period July 1, 2007, through June 30, 2008, for the purpose of 28 covering incurred costs arising out of hazardous substance incidents. 29 SECTION 5. An emergency existing therefor, which emergency is hereby 30 declared to exist, this act shall be in full force and effect on and after its 31 passage and approval.

Idaho Code authorizes the use of deficiency warrants under certain circumstances. The agencies pay the bills and come back to the legislature during the next session for the cash to reimburse those costs. This legislation includes reimbursement for the costs incurred for three purposes. First, it includes funding to reimburse the Department of Lands for the costs of fire suppression during the 2007 season. Second, it reimburses the Department of Agriculture for fiscal year 2007 costs to survey for pests on state and private lands. And third, it includes funding to reimburse the Military Division for costs incurred in fiscal year 2007 that are associated with the cleanup of hazardous materials incidents throughout Idaho.

This bill transfers a total of $21,824,300 from the General Fund to three deficiency warrant funds for fiscal year 2008 as follows:
1) The Idaho Department of Lands estimated the 2007 fire season to cost a total of $28.7 million. Taking into account anticipated reimbursements of $6.2 million and beginning balances of $1.1 million, $21.5 million was appropriated from the General Fund for transfer into the Fire Suppression Deficiency Fund.
2) The Idaho Department of Agriculture issued deficiency warrants that included $21,400 for a gypsy moth survey, $76,200 for an exotic pest survey, and $157,400 for potato cyst nematode (PCN) survey and treatment. As a result, $255,000 was appropriated from the General Fund for transfer into the Pest Control Deficiency Fund. These are the actual costs incurred by the department after taking into account federal reimbursements.
3) The Military Division estimated that costs associated with the cleanup of hazardous materials incidents throughout the state totaled $108,500. Of that amount, $37,800 was paid by the responsible parties involved and $70,700 was paid by the issuance of deficiency warrants; however, an additional $1,400 was later recovered after the issuance of deficiency warrants. As a result, $69,300 was appropriated from the General Fund for transfer into the Hazardous Substance Emergency Response Fund. In addition, the Military Division is granted a continuous appropriation of moneys collected as a result of incurred costs arising out of hazardous substance incidents.
