  1                                        AN ACT
  2    RELATING TO DRIVER TRAINING COURSES; AMENDING SECTION 33-1702, IDAHO CODE,  TO
  3        REMOVE  PROVISIONS  ALLOWING  FOR  SIMULATED  DRIVING  PRACTICE IN LIEU OF
  4        ACTUAL DRIVING PRACTICE; AND AMENDING  SECTION  33-1706,  IDAHO  CODE,  TO
  5        REQUIRE THE TIMELY SUBMISSION OF EACH DRIVER TRAINING COURSE REPORT WITHIN
  6        THE TIME LIMIT SPECIFIED AND TO MAKE A TECHNICAL CORRECTION.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION  1.  That  Section 33-1702, Idaho Code, be, and the same is hereby
  9    amended to read as follows:

 10        33-1702.  MINIMUM STANDARDS FOR COURSES. (1) The state board of  education
 11    and  the transportation department shall cooperate in establishing, and amend-
 12    ing as need arises, minimum standards for driver training  programs  reimburs-
 13    able hereunder.
 14        (2)  Such standards shall require not less than thirty (30) clock hours of
 15    classroom  instruction,  six  (6)  hours observation time in a driver training
 16    car, and six (6) hours behind-the-wheel practice driving; but the state  board
 17    of  education may allow in lieu of not more than three (3) hours of such prac-
 18    tice driving, such equivalent thereof in simulated  practice  driving  as  the
 19    said  board  may have, by uniform rules, approved. The board shall adopt stan-
 20    dards necessary to allow completion of the thirty (30) clock hours of required
 21    classroom instruction through an approved correspondence course.

 22        SECTION 2.  That Section 33-1706, Idaho Code, be, and the same  is  hereby
 23    amended to read as follows:

 24        33-1706.  REPORTS  TO  STATE DEPARTMENT OF EDUCATION. Each school district
 25    which has completed a course or courses in driver training,  whether  approved
 26    for  reimbursement  or  not,  shall submit a report to the state department of
 27    education not later than forty-five (45) days after completion of  the  course
 28    or  courses, showing: (1) the number of pupils who enrolled; (2) the number of
 29    pupils who completed the course; and (3) the total cost of  operation  of  the
 30    program,  together with such other information as the state board may require.
 31    Failure to submit each reports to the state department  of  education  in  the
 32    time  frame  required  shall be cause for the state department of education to
 33    disallow reimbursement even for prior approved driver training program.

                       STATEMENT OF PURPOSE

                             RS 17867

This legislation makes two changes to Idaho driver's education
statutes.  The first deletes the State Board of Education's
ability to waive half of the requirement that students receive at
least six hours of behind-the-wheel experience, by substituting
three hours of simulated practice driving.  The second change
clarifies that school districts will file their driver training
course reports with the State Department of Education within 45
days of the completion of each course.



                           FISCAL NOTE

No fiscal impact to the General Fund.
