]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1508 BY FINANCE COMMITTEE 1 AN ACT 2 RELATING TO APPROPRIATIONS FOR THE DEPARTMENT OF CORRECTION; APPROPRIATING 3 ADDITIONAL MONEYS TO THE DEPARTMENT OF CORRECTION FOR THE PRIVATELY- 4 OPERATED STATE PRISON FOR FISCAL YEAR 2008; REDUCING THE APPROPRIATION TO 5 THE DEPARTMENT OF CORRECTION FOR THE PRIVATELY-OPERATED PRISON FOR FISCAL 6 YEAR 2008; PROVIDING FOR THE TRANSFER OF UNOBLIGATED GENERAL FUNDS TO THE 7 IDAHO STATE BUILDING AUTHORITY FOR FISCAL YEAR 2008; APPROPRIATING ADDI- 8 TIONAL MONEYS TO THE DEPARTMENT OF CORRECTION FOR THE IDAHO CORRECTIONAL 9 CENTER FOR FISCAL YEAR 2009; REDUCING THE APPROPRIATION TO THE DEPARTMENT 10 OF CORRECTION FOR THE IDAHO CORRECTIONAL CENTER FOR FISCAL YEAR 2009; AND 11 DECLARING AN EMERGENCY FOR SECTIONS 1, 2 AND 3 OF THIS ACT. 12 Be It Enacted by the Legislature of the State of Idaho: 13 SECTION 1. In addition to the appropriation made in Section 1, Chapter 14 217, Laws of 2007, there is hereby appropriated to the Department of Correc- 15 tion for the Privately-Operated State Prison the following amount to be 16 expended according to the designated expense classes from the listed fund for 17 the period July 1, 2007, through June 30, 2008: 18 FOR: 19 Operating Expenditures $ 171,500 20 Capital Outlay 4,504,000 21 TOTAL $4,675,500 22 FROM: 23 General Fund $4,675,500 24 SECTION 2. Notwithstanding any other provision of law to the contrary, 25 the appropriation of moneys made in Section 1, Chapter 217, Laws of 2007, to 26 the Department of Correction for the Privately-Operated State Prison is hereby 27 reduced by $67,300 from the Inmate Labor Fund for operating expenditures for 28 the period July 1, 2007, through June 30, 2008. 29 SECTION 3. Notwithstanding the provisions of Section 5, Chapter 217, Laws 30 of 2007, the Department of Correction may transfer any unobligated General 31 Funds appropriated to the department for fiscal year 2008, to the Idaho State 32 Building Authority for the period July 1, 2007, through June 30, 2008, for the 33 purpose of aiding in the conversion of the Prison Industry Enterprise facility 34 to treatment beds at the Idaho Correctional Center. 35 SECTION 4. In addition to any other appropriation provided by law, there 36 is hereby appropriated to the Department of Correction for the Idaho Correc- 37 tional Center the following amount to be expended according to the designated 38 expense classes from the listed fund for the period July 1, 2008, through June 39 30, 2009: 2 1 FOR: 2 Operating Expenditures $1,124,200 3 Capital Outlay 296,800 4 TOTAL $1,421,000 5 FROM: 6 General Fund $1,421,000 7 SECTION 5. Notwithstanding any other provision of law to the contrary, 8 the appropriation to the Department of Correction for the Idaho Correctional 9 Center is hereby reduced by $404,000 from the Inmate Labor Fund for operating 10 expenditures for the period July 1, 2008, through June 30, 2009. 11 SECTION 6. An emergency existing therefor, which emergency is hereby 12 declared to exist, Sections 1, 2 and 3 of this act shall be in full force and 13 effect on and after passage and approval.

The purpose of this appropriation is to convert a state-owned 42,000 square foot Prison Industry Enterprise (PIE) building to 304 minimum custody treatment beds to address substance abuse issues for those offenders committed to the Department of Correction. This bill appropriates $4,675,500 from the General Fund to the Department of Correction for the Privately-Operated State Prison for fiscal year 2008; reduces the appropriation to the Department of Correction for the Privately-Operated State Prison by $67,300 from the Inmate Labor Fund for fiscal year 2008; provides for the transfer of unobligated General Funds to the Idaho State Building Authority for fiscal year 2008 for the purpose of aiding in the conversion of the Prison Industry Enterprise facility to treatment beds; appropriates $1,421,000 from the General Fund to the Department of Correction for the Privately-Operated State Prison for fiscal year 2009; and reduces the appropriation to the Department of Correction for the Privately-Operated State Prison by $404,000 from the Inmate Labor Fund for fiscal year 2009.
