]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1511 BY FINANCE COMMITTEE 1 AN ACT 2 RELATING TO APPROPRIATIONS; TO PROVIDE LEGISLATIVE FINDINGS REGARDING WATER 3 PROJECTS; APPROPRIATING AND DIRECTING THE TRANSFER OF GENERAL FUND MONEYS 4 TO THE IDAHO WATER RESOURCE REVOLVING DEVELOPMENT FUND FOR FISCAL YEAR 5 2009; APPROPRIATING AND DIRECTING THE TRANSFER OF GENERAL FUND MONEYS TO 6 THE IDAHO WATER RESOURCE BOARD REVOLVING DEVELOPMENT FUND FOR FISCAL YEAR 7 2008; AND DECLARING AN EMERGENCY FOR SECTION 3 OF THIS ACT. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. The Legislature recognizes the need for additional water sup- 10 plies in the state of Idaho and the Legislature finds that it is in the best 11 interests of the citizens of the state of Idaho to invest in short-term and 12 long-term water projects to facilitate a balance between water use and water 13 supply of Idaho's aquifers. 14 SECTION 2. There is hereby appropriated and the State Controller shall 15 transfer on July 1, 2008, or as soon thereafter as possible, the amount of 16 $1,800,000 from the General Fund to the Idaho Water Resource Board Revolving 17 Development Fund established in Section 42-1752, Idaho Code, for the period 18 July 1, 2008, through June 30, 2009. The Idaho Water Resource Board shall use 19 such moneys for costs associated with determining the feasibility of addi- 20 tional water storage. 21 SECTION 3. There is hereby appropriated $10,000,000 from the General Fund 22 for the period July 1, 2007, through June 30, 2008. The State Controller shall 23 immediately transfer that amount to the Idaho Water Resource Board Revolving 24 Development Fund established in Section 42-1752, Idaho Code. Such moneys shall 25 be used by the Idaho Water Resource Board to facilitate water projects involv- 26 ing the acquisition of water supply, reduction of water demand, and improve- 27 ment of water management. 28 SECTION 4. An emergency existing therefor, which emergency is hereby 29 declared to exist, Section 3 of this act shall be in full force and effect on 30 and after passage and approval.

This appropriation bill has two purposes. It funds $10 million for water projects in FY 2008 and $1.8 million for water storage studies in FY 2009.
Governor Otter at his April 17, 2007 Water Summit challenged Idahoans to develop a long-term vision for addressing existing and looming surface and ground water supply conflicts within the State of Idaho. Since the Governor issued his challenge, the Idaho Water Resource Board has been developing a Comprehensive Aquifer Management Plan (CAMP) for the Eastern Snake River Plain Aquifer.
The purpose of the FY 2008 appropriation is to put in place a funding source to implement long-term water supply solutions. The Idaho Water Resource Board has identified one such solution. The Board is in the process of facilitating the purchase of a large private fish hatchery. The Board has two partners that will pay the majority of the purchase price for the facility. This appropriation will be used, like the Bell Rapids appropriation, to fund the initial purchase. Once acquired, the water rights will be used by one partner to address a pending water delivery call and by the other partner to provide water to address present and future domestic and municipal water supply needs.
The facility will be owned by the Idaho Water Resource Board. The assets will be available to secure the financing and ultimately to replenish the revolving fund to address other water supply problems.
The ultimate responsibility for addressing water supply problems rests with the water users. This appropriation represents the State’s commitment, however, to facilitate solutions between affected water users.
The purpose of the FY 2009 appropriation of $1.8 million is to study the feasibility of enlarging Minidoka Dam and replacing Teton Dam.

This appropriation bill has two purposes. First, it appropriates $10 million for FY 2008 from the General Fund and transfers it to the continuously appropriated Idaho Water Resource Board Revolving Development Fund to facilitate the purchase of a fish hatchery and its water rights. Second, the bill trails HJM8 and appropriates $1.8 million from the General Fund for FY 2009 and transfers it to the Revolving Development Fund to pay the estimated $1.4 million costs of determining the feasibility of enlarging Minidoka Dam and $400,000 estimated costs of studying the replacement of the Teton Dam. The total General Fund impact of this bill is $11.8 million.
