]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 132 BY JUDICIARY AND RULES COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DIVI- 3 SION OF BUILDING SAFETY RELATING TO RULES GOVERNING CIVIL PENALTIES. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Division of Building Safety relating to Rules Governing Civil Penalties are 11 not consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 13 sion of the Fifty-ninth Idaho Legislature, the Senate and the House of Repre- 14 sentatives concurring therein, that IDAPA 07.02.07, Rules Governing Civil Pen- 15 alties, adopted as a pending rule under Docket Number 07-0207-0701, Division 16 of Building Safety, the entire rulemaking docket, be, and the same is hereby 17 rejected and declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS17942 This concurrent resolution would reject a pending rule of the Division of Building Safety pertaining to the Rules Governing Civil Penalties. The effect of this resolution, if adopted by both houses, would be to prevent the agency rule from going into effect. FISCAL NOTE This concurrent resolution has no fiscal impact.
