  1                                        AN ACT
  2    RELATING TO FISH AND GAME; AMENDING SECTION 36-706, IDAHO CODE, TO PROVIDE FOR
  3        ISSUANCE OF CERTAIN LIVE FISH TRANSPORTATION PERMITS WITHOUT FEE.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION 1.  That Section 36-706, Idaho Code, be, and the  same  is  hereby
  6    amended to read as follows:
                                                                        
  7        36-706.  PRIVATE  PARKS  AND PONDS -- NONCOMMERCIAL -- PERMIT REQUIRED. No
  8    person shall establish and maintain a private park or pond on  premises  owned
  9    or leased by him and obtain, possess, transport, propagate and process for his
 10    own  personal pleasure and use any fish approved by the commission, or any big
 11    game animals found wild in this state unless he has first  obtained  a  permit
 12    from the director.
 13        (a)  Permit  Requirements.  Such permit may be issued by the director upon
 14    his finding that:
 15        1.  Such private park or pond is not constructed in or across any  natural
 16        stream  bed,  lake, or other watercourse containing wild fish, or on lands
 17        where wildlife abounds, except when it has been determined by the  commis-
 18        sion that the water flow and volume of wildlife concerned in such proposed
 19        private  ponds, waters or parks are not a significant part of the wildlife
 20        resource of the state.
 21        2.  The private park or pond is located entirely on private property owned
 22        or leased by the applicant.
 23        3.  Any dam constructed to divert water into such private pond  meets  all
 24        requirements as provided in section 36-906(a), Idaho Code.
 25        4.  All inlets to such private pond are screened at the point of diversion
 26        as  provided  in section 36-906(b), Idaho Code, to prevent the entrance of
 27        wild fish into the private pond.
 28        5.  The application for such permit is made upon a form  provided  by  the
 29        department  which  sets  forth  such information as may be required by the
 30        director.
 31        6.  The lands proposed for use as a park are so fenced as to  prevent  the
 32        escape of private wildlife therefrom and prevent the entry thereon of pub-
 33        licly owned big game animals.
 34        7.  Said  park  or  pond shall be posted in three (3) separate conspicuous
 35        places and all entrance roads.
 36        (b)  Separate Locations -- Permits Required. Such a park  or  pond  permit
 37    must be had for each and every location. A park permit may be had upon payment
 38    of  a fee as specified in section 36-416, Idaho Code. Said permit shall expire
 39    June 30 in each year. A pond permit shall expire on June 30 of the fifth  fis-
 40    cal year after the date of issue.
 41        (c)  Live  Fish  Transportation Permit. The commission may, under rules as
 42    it may prescribe, issue a live fish transportation permit. The permit  may  be
 43    had  upon  payment of a fee as specified in section 36-416, Idaho Code. No fee

  1    shall be charged for a department benefit permit.

                     STATEMENT OF PURPOSE

                             RS 12391

This bill will allow the Department of Fish and Game to issue
certain Live Fish Transportation Permits without a fee. There would
be no fee for permits issued that the Director determines provide
a benefit to the Department and/or fish and wildlife. These permits
would primarily be issued to Federal Agencies, State Universities
and Indian Tribes.
