SPEAKER Requested by: Bureau of Occupational Licenses 1 AN ACT 2 RELATING TO ACUPUNCTURE; AMENDING SECTION 54-4703, IDAHO CODE, TO REMOVE CER- 3 TAIN LICENSURE ELIGIBILITY PROVISIONS; AMENDING SECTION 54-4707, IDAHO 4 CODE, TO REVISE CERTIFICATION REQUIREMENTS; AND AMENDING SECTION 54-4710, 5 IDAHO CODE, TO REVISE PERMISSIBLE LICENSING FEES. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 54-4703, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 54-4703. LICENSE REQUIRED. (1) From and after the 1st day of July, 1999, 10 it is unlawful for any person to practice acupuncture in this state without, 11 at such time being licensed or certified pursuant to this chapter; provided 12 however, the provisions of this chapter shall not apply to persons licensed 13 pursuant to chapter 18, title 54, Idaho Code, but such persons may seek licen- 14 sure or certification pursuant to this chapter on a voluntary basis. 15 (2) No person shall use any title, designation, words, letters, abbrevia- 16 tions, or sign, card or device which indicates to the public that such person 17 may practice acupuncture in any form or has been issued a license or been cer- 18 tified pursuant to this chapter unless the person is so licensed or certified, 19 has been issued such license or certification, and the license or certifica- 20 tion is in good standing pursuant to rules of the board. 21(3) A person who meets NCCAOM eligibility criteria for certification22shall be considered by the board as meeting the requirements for licensure23pursuant to this chapter. This provision shall be effective until one (1) year24after the effective date of this act. Thereafter all applicants for licensure25must meet the licensing requirement of this chapter.26(4) A person who meets the requirements for full or associate membership27of the American academy of medical acupuncture, or for fellowship of the28international academy of medical acupuncture, inc., shall be considered by the29board as meeting the requirements for certification pursuant to this chapter.30This provision shall be effective until one (1) year after the effective date31of this act. Thereafter all applicants for certification must meet the certi-32fication requirement of this chapter.33 SECTION 2. That Section 54-4707, Idaho Code, be, and the same is hereby 34 amended to read as follows: 35 54-4707. REQUIREMENTS FOR CERTIFICATION. A person applying for a certifi- 36 cation shall, in addition to paying all required fees, submit a written appli- 37 cationprovidedapproved by the board showingto the satisfaction of the board38 that such personmeets the following requirementshas successfully passed an 39 examination or other demonstration of proficiency as may be uniformly required 40 by the board and: 41 (1) Has successfully completed the requirements for full membership in 2 1 the American academy of medical acupuncture, fellowship in the international2academy of medical acupuncture, inc., or such other comparable requirements as3have been approved by the board;andor 4 (2) Haspassed an examination or other demonstration of proficiency as5may be uniformly required by the board for other similarly qualified appli-6cants for certificationmet each of the following education and experience 7 requirements: 8 (a) Possesses a doctor of chiropractic, doctor of dentistry, doctor of 9 podiatric medicine or naturopathic doctor degree from an accredited col- 10 lege or university, or is a registered nurse practitioner; and 11 (b) Has successfully completed a minimum of one hundred (100) hours of 12 didactic coursework, two hundred (200) hours of practice as a certified 13 technician over a one (1) year period and twenty-five (25) case studies; 14 and 15 (c) Has successfully completed a blood borne pathogen course and compre- 16 hensive examination that incorporates clean needle techniques and OSHA 17 procedures and requirements; or 18 (3) Has met such other comparable requirements as approved by the board. 19 SECTION 3. That Section 54-4710, Idaho Code, be, and the same is hereby 20 amended to read as follows: 21 54-4710. EXPIRATION AND RENEWAL. (1) A license or certification issued 22 under the provisions of this chapter shall be subject to annual renewal and 23 shall expire unless renewed in the manner prescribed by the rules of the 24 board, upon payment of a renewal fee. 25 (2) The board shall establish the following fees relating to licensing, 26 which fees shall be established in an amount that is sufficient to defray all 27 costs necessary for the administration of this chapter: 28 (a) Initial license, certification or technician certificate; 29 (b) Renewal of license,feecertification or technician certificate; 30 (c)Initial feeApplication for license, certification or technician cer- 31 tificate; 32 (d)Initial acupunctureReinstatement of license, certification or tech- 33 nician certificate; 34 (e)Renewal acupuncture technician certificate;35(f)Inactive license and certification fees.;36(g) Late renewal fees.
STATEMENT OF PURPOSE RS 12365C1 54-4703 - 54-4707 update the eligibility criteria for certification by requiring applicants for certification be a currently licensed health care practitioner (Dr. of chiropractic, Dr. of dentistry, Dr. of podiatric medicine, or naturopathic doctor possessing a degree from an accredited college or university or a registered nurse practitioner, establishing minimum education requirements and Blood Borne Pathogen course. This change also deletes the Boards reliance on the requirements of third party entities and organizations. FISCAL IMPACT There is no fiscal impact on General or Dedicated funds.
