  1                                        AN ACT
  2    RELATING TO HEALTH AND SAFETY; AMENDING SECTION 39-2001, IDAHO CODE, TO REMOVE
  3        BARBER SHOPS, HAIRDRESSING PARLORS AND RETAIL COSMETIC  DEALERS  FROM  THE
  4        JURISDICTION  OF THE DIRECTOR OF THE DEPARTMENT OF HEALTH AND WELFARE; AND
  5        AMENDING SECTION 39-2003, IDAHO CODE, TO DELETE LANGUAGE REQUIRING  BARBER
  6        SHOPS,  HAIRDRESSING PARLORS AND RETAIL COSMETICS DEALERS TO OBTAIN A CER-
  7        TIFICATE OF COMPLIANCE FROM THE DIRECTOR AND  TO  MAKE  TECHNICAL  CORREC-
  8        TIONS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 39-2001, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        39-2001.  JURISDICTION OF DIRECTOR. In the interest of the  public  health
 13    and  to prevent the spread of contagious and infectious diseases, the director
 14    of the department of health and welfare is charged with the sanitary  supervi-
 15    sion of all barber shops, hairdressing parlors, retail cosmetics dealers, pub-
 16    lic  bathhouses,  public  bathrooms  and public bathing places in the state of
 17    Idaho.
                                                                        
 18        SECTION 2.  That Section 39-2003, Idaho Code, be, and the same  is  hereby
 19    amended to read as follows:
                                                                        
 20        39-2003.  CERTIFICATE  OF  COMPLIANCE.  Upon any such establishment herein
 21    being found to be in a sanitary condition, by the director, and complying with
 22    the regulations rules provided for in the  preceding  section  39-2002,  Idaho
 23    Code,  a  certificate  shall be issued by said director without any cost, good
 24    for the year in which it is issued, which shall be kept posted in a  conspicu-
 25    ous place. The owner, lessee, or manager of any barber shop, hairdressing par-
 26    lor,  retail  cosmetics  dealer, public bathroom, bathhouse, or bathing resort
 27    who operates his business in violation of this provision shall be guilty of  a
 28    misdemeanor  and  punished as provided in the preceding section 39-2002, Idaho
 29    Code.

                             RS 12357

39-2001 striking language removing the sanitary supervision of
barber shops, hairdressing parlors, retail cosmetics dealers from
the jurisdiction of the Director of Health and Welfare. 

39-2003 striking from certificate of compliance language dealing
with barber shops, hairdressing parlors, retail cosmetics dealers.
