SPEAKER Requested by: Professional Board of Engineers and Land Surveyors 1 AN ACT 2 RELATING TO PROFESSIONAL ENGINEERS AND PROFESSIONAL LAND SURVEYORS; AMENDING 3 SECTION 54-1212, IDAHO CODE, TO REVISE REQUIREMENTS FOR EXAMINATIONS; 4 AMENDING SECTION 54-1212, IDAHO CODE, AS AMENDED BY SECTION 1, CHAPTER 5 125, LAWS OF 2002, TO REVISE REQUIREMENTS FOR EXAMINATIONS; AND AMENDING 6 SECTION 54-1219, IDAHO CODE, TO CLARIFY THAT THE LICENSING BOARD MAY EVAL- 7 UATE CREDENTIALS OF APPLICANTS FOR EQUIVALENCY LICENSURE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 54-1212, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 54-1212. GENERAL REQUIREMENTS FOR EXAMINATION AND LICENSE. Except as 12 herein otherwise expressly provided, no license as a professional engineer or 13 professional land surveyor, or certification as an engineer-in-training or 14 land surveyor-in-training, shall be issued until an applicant has successfully 15 passed an examination given by or under the supervision of the board, nor 16 shall a license as a professional engineer or professional land surveyor, or 17 certification as an engineer-in-training or land surveyor-in-training, be 18 issued to an applicant having habits or character that would justify revoca- 19 tion or suspension of certificate, as provided in section 54-1220, Idaho Code. 20 The following shall be considered as minimum evidence satisfactory to the 21 board that the applicant is qualified for assignment to an examination: 22 (1) As a professional engineer: 23 (a) Graduation from an approved engineering curriculum of four (4) years 24 or more in a school or college approved by the board as being of satisfac- 25 tory standing, passage of an examination on the fundamentals of engineer- 26 ing acceptable to the board, and a specific record of an additional four 27 (4) years or more of progressive experience in engineering work of a grade 28 and character satisfactory to the board, and indicating that the applicant 29 is competent to practice professional engineering; or 30 (b) Graduation with a bachelor's degree in a related science from a 31 school or college approved by the board, and eEvidence satisfactory to the 32 board that the applicant possesses knowledge and skill approximating that 33 attained through graduation from an approved four (4) year engineering 34 curriculum,graduation with a bachelor degree in a related science from a35school or college approved by the board,passage of an examination on the 36 fundamentals of engineering acceptable to the board, and a specific record 37 ofeightan additional four (84) years or more of progressive experience 38 in engineering work of a grade and character satisfactory to the board and 39 indicating that the applicant is competent to practice professional engi- 40 neering. 41 (2) As a professional land surveyor: 42 (a) Graduation from an approved surveying curriculum of four (4) years or 43 more in a school or college approved by the board as being of satisfactory 2 1 standing, passage of an examination on the fundamentals of land surveying 2 acceptable to the board, and a specific record of an additional four (4) 3 years or more of progressive combined office and field experience in land 4 surveying work,with a minimum of two (2) years of progressive experience5in land surveying workof a grade and character satisfactory to the board 6 and indicating that the applicant is competent to practice professional 7 land surveying; or 8 (b) At least sixty (60) semester hours of college level academic educa- 9 tion beyond high school, with a minimum of fifteen (15) credits in land 10 surveying, engineering, mathematics or related science, passage of an 11 examination on the fundamentals of land surveying acceptable to the board, 12 and a specific record of an additional six (6) years of progressive com- 13 bined office and field experience in land surveying work, with a minimum14of two (2) years of progressive experience in land surveying workof a 15 grade and character satisfactory to the board and indicating that the 16 applicant is competent to practice land surveying; or 17 (c) Evidence that the applicant possesses knowledge and skill, satisfac- 18 tory to the board, similar to that attained upon completion of an approved 19 college level academic curriculum, passage of an examination on the funda- 20 mentals of land surveying acceptable to the board, and evidence of a spe- 21 cific record ofat leastan additional eight (8) years of progressive com- 22 bined office and field experience in land surveying workwith a minimum of23three (3) years of progressive experience in land surveying workof a 24 grade and character satisfactory to the board and indicating that the 25 applicant is competent to practice land surveying. 26 (3) As an engineer-in-training: 27 (a) Graduation from or in the last two (2) semesters of an approved engi- 28 neering curriculum of four (4) years or more in a school or college 29 approved by the board as being of satisfactory standing and indicating 30 that the applicant is competent to enroll as an engineer-in-training; or 31 (b) Graduation with a bachelor's degree in a related science from a 32 school or college approved by the board as being of satisfactory standing, 33 and eEvidence satisfactory to the board that the applicant possesses 34 knowledge and skill approximating that attained through graduation from an 35 approved four (4) year engineering curriculum,graduation with a bachelor36degree in a related science from a school or college approved by the37board, and a specific record of one (1) year or more of progressive expe-38rience in engineering work of a character satisfactory to the boardand 39 indicating that the applicant is competent to be enrolled as an engineer- 40 in-training. 41 (c) In the event the applicant qualifies for assignment to the examina- 42 tion during the last two (2) semesters of college under the provisions of 43 section 54-1212(3)(a), Idaho Code, and a passing grade is attained, a cer- 44 tificate will be issued only after the applicant graduates. 45 (4) As a land surveyor-in-training: 46 (a) Graduation from, or in the last two (2) semesters of, an approved 47 surveying curriculum of four (4) years or more in a school or college 48 approved by the board as being of satisfactory standing and indicating 49 that the applicant is competent to be enrolled as a land surveyor-in- 50 training; or 51 (b) At least sixty (60) semester hours of college level academic educa- 52 tion beyond high school, with a minimum of fifteen (15) credits in land 53 surveying, engineering, mathematics or related science, and in addition, a 54 specific record of three (3) years or more of progressive combined office 55 and field experience in land surveying work of a grade and character sat- 3 1 isfactory to the board that the applicant is competent to be enrolled as a 2 land surveyor-in-training; or 3 (c) Possesses knowledge and skill, satisfactory to the board, similar to 4 that attained upon completion of an approved college level academic cur- 5 riculum and evidence of a specific record of at least four (4) years expe- 6 rience of progressive combined office and field experience of a grade and 7 character satisfactory to the board that the applicant is competent to be 8 enrolled as a land surveyor-in-training. 9 In counting years of experience for assignment to the professional engi- 10 neer or professional land surveyor examination, the board may, at its discre- 11 tion, give credit, not in excess of one (1) year, for satisfactory graduate 12 study. 13 In considering the combined education and experience qualifications of 14 applicants, the board shall consider engineering teaching, land surveying 15 teaching, each year of satisfactory completion of undergraduate college educa- 16 tion, advanced degrees in engineering and advanced degrees in land surveying 17 in establishing the applicants' minimum composite knowledge and skill. 18 The mere execution, as a contractor, of work designed by a professional 19 engineer, or the supervision of the construction of such work as a foreman or 20 superintendent, shall not be deemed to be the practice of engineering, but if 21 such experience, in the opinion of the board, has involved responsible super- 22 vision of a character that will tend to expand the engineering knowledge and 23 skill of the applicant the board may in its discretion give such credit there- 24 for as it may deem proper. 25 Any person having the necessary qualifications prescribed in this chapter 26 to entitle him to registration shall be eligible for such registration 27 although he may not be practicing his profession at the time of making his 28 application. 29 SECTION 2. That Section 54-1212, Idaho Code, as amended by Section 1, 30 Chapter 125, Laws of 2002, be, and the same is hereby amended to read as fol- 31 lows: 32 54-1212. GENERAL REQUIREMENTS FOR EXAMINATION AND LICENSE. Except as 33 herein otherwise expressly provided, no license as a professional engineer or 34 professional land surveyor, or certification as an engineer-in-training or 35 land surveyor-in-training, shall be issued until an applicant has successfully 36 passed an examination given by or under the supervision of the board, nor 37 shall a license as a professional engineer or professional land surveyor, or 38 certification as an engineer-in-training or land surveyor-in-training, be 39 issued to an applicant having habits or character that would justify revoca- 40 tion or suspension of certificate, as provided in section 54-1220, Idaho Code. 41 The following shall be considered as minimum evidence satisfactory to the 42 board that the applicant is qualified for assignment to an examination: 43 (1) As a professional engineer: 44 (a) Graduation from an approved engineering curriculum of four (4) years 45 or more in a school or college approved by the board as being of satisfac- 46 tory standing, passage of an examination on the fundamentals of engineer- 47 ing acceptable to the board, and a specific record of an additional four 48 (4) years or more of progressive experience in engineering work of a grade 49 and character satisfactory to the board, and indicating that the applicant 50 is competent to practice professional engineering; or 51 (b) Graduation with a bachelor's degree in a related science from a 52 school or college approved by the board, and eEvidence satisfactory to the 53 board that the applicant possesses knowledge and skill approximating that 4 1 attained through graduation from an approved four (4) year engineering 2 curriculum,graduation with a bachelor degree in a related science from a3school or college approved by the board,passage of an examination on the 4 fundamentals of engineering acceptable to the board, and a specific record 5 ofeightfour (84) years or more of progressive experience in engineering 6 work of a grade and character satisfactory to the board and indicating 7 that the applicant is competent to practice professional engineering. 8 (2) As a professional land surveyor: 9 (a) Graduation from an approved surveying curriculum of four (4) years or 10 more in a school or college approved by the board as being of satisfactory 11 standing, passage of an examination on the fundamentals of land surveying 12 acceptable to the board, and a specific record of an additional four (4) 13 years or more of progressive combined office and field experience in land 14 surveying work, with a minimum of two (2) years of progressive experience15in land surveying workof a grade and character satisfactory to the board 16 and indicating that the applicant is competent to practice professional 17 land surveying; or 18 (b) Graduation with a bachelor's degree in a related science from a 19 school or college approved by the board as being of satisfactory standing, 20 and eEvidence satisfactory to the board that the applicant possesses 21 knowledge and skill approximating that attained through graduation from an 22 approved four (4) year surveying curriculum,graduation with a bachelor23degree in a related science from a school or college approved by the24board,passage of an examination on the fundamentals of land surveying 25 acceptable to the board, and a specific record ofeightan additional four 26 (84) years or more of progressiveexperience in surveying work, constitut-27ing six (6) years ofcombined office and field experience in land survey- 28 ing work, with a minimum of two (2) years of progressive experience in29land surveying workof a grade and character satisfactory to the board and 30 indicating that the applicant is competent to practice land surveying. 31 (3) As an engineer-in-training: 32 (a) Graduation from or in the last two (2) semesters of an approved engi- 33 neering curriculum of four (4) years or more in a school or college 34 approved by the board as being of satisfactory standing and indicating 35 that the applicant is competent to enroll as an engineer-in-training; or 36 (b) Graduation with a bachelor's degree in a related science from a 37 school or college approved by the board, and eEvidence satisfactory to the 38 board that the applicant possesses knowledge and skill approximating that 39 attained through graduation from an approved four (4) year engineering 40 curriculum,graduation with a bachelor degree in a related science from a41school or college approved by the board, and a specific record of one (1)42year or more of progressive experience in engineering work of a character43satisfactory to the boardand indicating that the applicant is competent 44 to be enrolled as an engineer-in-training. 45 (c) In the event the applicant qualifies for assignment to the examina- 46 tion during the last two (2) semesters of college under the provisions of 47 section 54-1212(3)(a), Idaho Code, and a passing grade is attained, a cer- 48 tificate will be issued only after the applicant graduates. 49 (4) As a land surveyor-in-training: 50 (a) Graduation from, or in the last two (2) semesters of, an approved 51 surveying curriculum of four (4) years or more in a school or college 52 approved by the board as being of satisfactory standing and indicating 53 that the applicant is competent to be enrolled as a land surveyor-in- 54 training; or 55 (b) Graduation with a bachelor's degree in a related science from a 5 1 school or college approved by the board, eEvidence satisfactory to the 2 board that the applicant possesses knowledge and skill approximating that 3 attained through graduation from an approved four (4) year surveying cur- 4 riculum,graduation with a bachelor degree in a related science from a5school or college approved by the board, and in addition, a specific6record of one (1) year or more of combined office and field experience in7land surveying work of a character satisfactory to the boardand indicat- 8 ing that the applicant is competent to be enrolled as a land surveyor-in- 9 training. 10 (c) In the event the applicant qualifies for assignment to the examina- 11 tion during the last two (2) semesters of college under the provisions of 12 subsection (4)(a) of this section, and attains a passing grade, a certifi- 13 cate shall be issued only after the applicant graduates. 14 In counting years of experience for assignment to the professional engi- 15 neer or professional land surveyor examination, the board may, at its discre- 16 tion, give credit, not in excess of one (1) year, for satisfactory graduate 17 study. 18 In considering the combined education and experience qualifications of 19 applicants, the board shall consider engineering teaching, land surveying 20 teaching, each year of satisfactory completion of undergraduate college educa- 21 tion, advanced degrees in engineering and advanced degrees in land surveying 22 in establishing the applicants' minimum composite knowledge and skill. 23 The mere execution, as a contractor, of work designed by a professional 24 engineer, or the supervision of the construction of such work as a foreman or 25 superintendent, shall not be deemed to be the practice of engineering, but if 26 such experience, in the opinion of the board, has involved responsible super- 27 vision of a character that will tend to expand the engineering knowledge and 28 skill of the applicant the board may in its discretion give such credit there- 29 for as it may deem proper. 30 Any person having the necessary qualifications prescribed in this chapter 31 to entitle him to registration shall be eligible for such registration 32 although he may not be practicing his profession at the time of making his 33 application. 34 SECTION 3. That Section 54-1219, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 54-1219. COMITY CERTIFICATION -- FEE. The board, upon application there- 37 for and the payment of a fee of not to exceed a maximum of one hundred fifty 38 dollars ($150), may issue a certificate of registration as a professional 39 engineer or professional land surveyor to any person who holds a certificate 40 of registration issued to the applicant by the proper authority of any state, 41 territory or possession of the United States, the District of Columbia, or of 42 a foreign country, provided that, in the opinion of the board, the applicant 43 possesses the education, experience and examination credentials, or their 44 equivalents, that were specified in the applicable registration chapter in 45 effect in this state at the time such certificate was issued, provided that a 46 professional land surveyor applicant must successfully pass a land surveying 47 examination as prepared and administered by the board, and provided such 48 state, territory, possession or country will license or issue certificates of 49 registration, without examination and upon substantially the same condition, 50 to applicants holding licenses or certificates of registration issued by the 51 board under this chapter.
STATEMENT OF PURPOSE RS 12331 Under the current law, applicants who do not possess an engineering or surveying degree are required to demonstrate that they possess the equivalent of such a degree, yet are required to have twice as much experience as a person with an engineering or surveying degree. This amendment would eliminate that inequity. Licenses can currently be issued by the Board to applicants who are licensed in other jurisdictions if the applicants possess the credentials that were in effect in Idaho at the time they were licensed elsewhere. This amendment would clarify that the evaluation of the applicants credentials is the responsibility of the Board, and that equivalent credentials can be accepted by the Board. FISCAL IMPACT These amendments would have no impact on the revenues or expenses of the General Fund of the state of Idaho or the dedicated fund of the Board. CONTACT Name: David L. Curtis, P.E.
