SPEAKER Requested by: Department of Parks and Recreation 1 AN ACT 2 RELATING TO SNOWMOBILES; AMENDING SECTION 67-7103, IDAHO CODE, TO PROVIDE THAT 3 AN OWNER OF A SNOWMOBILE SHALL ATTACH TO THE SNOWMOBILE THE IDENTIFICATION 4 NUMBER IN A MANNER AS MAY BE PRESCRIBED BY RULES OF THE DEPARTMENT; AND 5 AMENDING SECTION 67-7104, IDAHO CODE, TO PROVIDE APPLICATION OF THE NUM- 6 BERING REQUIREMENT TO A NONRESIDENT, NONCOMMERCIAL OWNER OF A SNOWMOBILE 7 AND TO ALLOW THE REQUIREMENTS FOR THE NONRESIDENT CERTIFICATE TO BE WAIVED 8 BY THE PARKS AND RECREATION BOARD UPON CERTAIN CONDITIONS. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 67-7103, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 67-7103. APPLICATION FOR NUMBER -- ATTACHMENT OF NUMBER -- CERTIFICATE -- 13 APPLICATION FOR TRANSFER OF CERTIFICATE -- TRANSFER OF CERTIFICATE FEE -- TEM- 14 PORARY NUMBER -- FEES. (1) On or before November 1 of each year the owner of 15 each snowmobile requiring numbering by the state of Idaho shall file an appli- 16 cation for number with the department on forms approved by it. The application 17 shall be signed by the owner and shall, except as provided in subsection (7) 18 of this section, be accompanied by a fee of twenty dollars ($20.00). Upon 19 receipt of the application the department shall issue to the applicant a cer- 20 tificate of number stating the number assigned to the snowmobile and the name 21 and address of the owner. The owner shallpaint on orattach to the snowmobile 22 the identification number in a manner as may be prescribed by rules of the 23 department. The number shall be located on the right and left side of the 24 cowling of the snowmobile and shall be completely visible and shall be main- 25 tained in legible condition. The certificate of number shall be pocket size 26 and shall be available at all times for inspection on the snowmobile for which 27 issued, wherever the snowmobile is in operation. 28 (2) The department may issue any certificate of number directly or may 29 authorize any persons to act as vendor for the issuance. In the event a person 30 accepts the authorization, he may be assigned a block of numbers and certifi- 31 cates which upon issue, in conformity with this chapter and with any rules of 32 the department, shall be valid as if issued directly by the department. 33 (3) All records of the department made or kept pursuant to this section 34 shall be public records. 35 (4) Each snowmobile must be registered before it leaves the premises at 36 the time of sale from any retail snowmobile dealer. 37 (5) The purchaser of a snowmobile shall, within fifteen (15) days immedi- 38 ately after acquisition, make application to the department for transfer to 39 him of the certificate of number issued to the snowmobile, giving his name, 40 address and the number of the snowmobile and shall at the same time pay to the 41 department a fee of three dollars ($3.00). Upon receipt of the application and 42 fee, the department shall transfer the certificate of number issued for the 43 snowmobile to the new owner or owners. Unless the application is made and fee 2 1 paid within fifteen (15) days, the snowmobile shall be considered to be with- 2 out a certificate of number and it shall be unlawful for any person to operate 3 that snowmobile until the certificate is issued. 4 (6) No number other than the number issued to a snowmobile pursuant to 5 this chapter shall be painted, attached, or otherwise displayed on the snowmo- 6 bile, except a temporary number may be attached to identify a snowmobile for 7 the purpose of racing or other sporting events. 8 (7) Resident and nonresident owners of snowmobiles used for rental pur- 9 poses shall purchase certificates of number for fifty dollars ($50.00) and the 10 certificates of number shall be displayed on the machine at all times. 11 SECTION 2. That Section 67-7104, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 67-7104. NONRESIDENT. (1) The provisions of this chapter shallnotapply 14 to a nonresident, noncommercial ownerwho hasof a snowmobile.which is cur-15rently numbered or licensed by his resident state or province, provided that16the resident state or province does not charge a snowmobiling fee to Idaho17residents. If a nonresident operates a snowmobile in this state for a period18in excess of fifteen (15) consecutive days, tThe owner shall be liable for and 19 shall pay to the director or his agent the fee as provided in section 67-7103, 20 Idaho Code. 21 (2)Notwithstanding the provisions of subsection (1) of this section,22aAll nonresident operators of snowmobiles used in Idaho shall comply with one 23 (1) of the following requirements: 24 (a) The snowmobile shall be registered in Idaho and the certificate of 25 number shall be displayed in the manner provided in section 67-7103, Idaho 26 Code; or 27 (b) The nonresident shall obtain a nonresident snowmobile user certifi- 28 cate upon payment of twenty dollars ($20.00) and the certificate of number 29 shall be displayed in the same manner as provided in section 67-7103, 30 Idaho Code. Such certificates shall be valid beginning November 1 through 31 October 31 of the following year. Issuance and administration of nonresi- 32 dent snowmobile user certificates shall be conducted in the same manner as 33 provided in section 67-7103, Idaho Code, for numbering of snowmobiles. 34 (3) For purposes of this section, "nonresident" shall be as defined in 35 section 36-202, Idaho Code. 36 (4) Requirements for the nonresident certificate may be waived by the 37 board, in accordance with all affected entities, on specific trails where the 38 snowmobile trail grooming is solely supported by means other than Idaho regis- 39 trations.

Issuance and adminis- 23 tration of nonresident snowmobile user certificates shall be conducted in 24 the same manner as provided in section 67-7103, Idaho Code, for numbering 25 of snowmobiles. 26 (31) For purposes of this section, "nonresident" shall be as defined in 27 section 36-202, Idaho Code. 28 (2) In the absence of a bona fide program in the area or upon the request 29 of the bona fide county snowmobile advisory committee of the nearest affected 30 county in Idaho, the requirements for the nonresident certificate may be 31 waived by the parks and recreation board on specific trails where the snowmo- 32 bile trail grooming is solely supported by a state other than Idaho.
STATEMENT OF PURPOSE RS 12340C1 This legislation amends Sec. 67-7103 to clarify that a snowmobile identification number shall be attached to the snowmobile in a manner as prescribed by rules of the department, and also amends Sec. 67-7104 to provide the IDPR Director authority to approve exemptions to the general rule requiring non-resident snowmobilers to purchase a non-resident snowmobile user certificate to operate within the boundaries of the state. With this amendment, the state can, by agreement, exempt snowmobilers who operate on snowmobile trails groomed and operated by a neighboring state that cross into Idaho, but receive no financial support from Idaho to operate on these trails, without purchasing the required non-resident certificate.
