  1                                        AN ACT
  2    RELATING TO THE IDAHO COMMISSION ON THE ARTS; AMENDING SECTION 67-5602,  IDAHO
  3        CODE,  TO  PROVIDE  THAT  THE  IDAHO  COMMISSION  ON  THE  ARTS  SHALL  BE
  4        ORGANIZATIONALLY SITUATED WITHIN THE OFFICE OF THE GOVERNOR.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section 67-5602, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        67-5602.  COMMISSION ON ARTS -- CREATION -- MEMBERSHIP.  There  is  hereby
  9    created and established within the office of the secretary of state governor a
 10    state  commission, to be known as the Idaho commission on the arts, to consist
 11    of thirteen (13) members, representative of the  public,  Idaho's  ethnic  and
 12    cultural  diversity,  the  various fields of the performing and fine arts, and
 13    all geographic areas of our state. Each member shall be appointed by the  gov-
 14    ernor  from  among citizens of the state who are widely known for their inter-
 15    est, competence, and experience in the performing and  fine  arts.  In  making
 16    such  appointments,  due  consideration  shall be given to the recommendations
 17    made by representative civic, educational and  professional  associations  and
 18    groups concerned with or engaged in production or presentation of the perform-
 19    ing and fine arts generally.

                      STATEMENT OF PURPOSE
                                
                            RS 12448

The Idaho Commission on the Arts is organizationally situated within the Office of the Secretary of State. 
However, the Arts Commission is appropriated funding separate from the Office of the Secretary of State. 
In addition, the Secretary of State does not direct the Arts Commission's operations or exercise oversight
over the activities of the Arts Commission in any way.  This legislation moves the Commission on the Arts
out from under the Secretary of State's office and places it within the Office of the Governor.  Such a
move accurately reflects the Arts Commission's autonomy and eliminates possible confusion about the
relationship between the Office of the Secretary of State and the Arts Commission.


                            FISCAL IMPACT

There is no fiscal impact.
