  1                                        AN ACT
  2    APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF  LANDS  FOR  FISCAL  YEAR
  3        2003;  PROVIDING  TRANSFERS  TO  THE FIRE SUPPRESSION DEFICIENCY FUND; AND
  4        DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  In addition to the appropriation made in  Section  1,  Chapter
  7    165,  Laws  of  2002,  there is hereby appropriated to the Department of Lands
  8    $5,085,000 from the Fire Suppression Deficiency Fund to be  expended  for  the
  9    Forest  and Range Fire Protection Program for the period July 1, 2002, through
 10    June 30, 2003.
                                                                        
 11        SECTION 2.  The State Controller shall make cash transfers from  the  Gen-
 12    eral  Fund  to  the  Fire  Suppression  Deficiency Fund, at the request of the
 13    Director of the Department of Lands, not to exceed $3,835,000 for  the  period
 14    July 1, 2002, through June 30, 2003.
                                                                        
 15        SECTION  3.  An  emergency  existing  therefor,  which emergency is hereby
 16    declared to exist, this act shall be in full force and effect on and after its
 17    passage and approval.

Statement of Purpose

This supplemental appropriation to the Department of Lands provides funding to reimburse deficiency warrants for the costs of fire suppression for the 2002 fire season. The department participates in cooperative fire fighting agreements with federal, local and other state agencies. The state is then responsible for the costs incurred for fire suppression on about 6.2 million acres of lands protected by the state regardless of ownership.

Fiscal Note

The bill includes $3,835,000 from the General Fund and $1,250,000 in dedicated spending authority for a total of $5,085,000. The department estimates personnel costs at $3.6 to $3.8 million and operating expenditures at $1.2 to $1.4 million for costs of fighting fires during the 2002 season. The dedicated funds represent spending authority for receipts received from federal agencies or other states for costs the department incurred to fight their fires. The appropriation is provided as lump-sum to allow the department to pay the actual costs from the correct standard object as those bills are finalized.
