2 RELATING TO MOTOR VEHICLES; AMENDING CHAPTER 5, TITLE 49, IDAHO CODE, BY THE
3 ADDITION OF A NEW SECTION 49-531, IDAHO CODE, TO REQUIRE A BRANDED CERTIF-
4 ICATE OF TITLE FOR VEHICLES ON WHICH THE ORIGINAL ODOMETER MILEAGE WAS
5 STATED IN KILOMETERS, TO REQUIRE WRITTEN DISCLOSURE BY SELLERS OF VEHI-
6 CLES, TO PROVIDE THAT SUCH WRITTEN DISCLOSURES SHALL BE INCLUDED WITH
7 APPLICATIONS FOR CERTIFICATES OF TITLE AND TO AUTHORIZE RULEMAKING.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Chapter 5, Title 49, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
11 ignated as Section 49-531, Idaho Code, and to read as follows:
12 49-531. ODOMETER CONVERSION. (1) A person acquiring a vehicle on which
13 the original odometer mileage was stated in kilometers shall obtain a branded
14 certificate of title as provided in this section.
15 (2) The department shall issue a branded certificate of title on any
16 motor vehicle for which evidence has been submitted that the original odometer
17 device recorded distance traveled in kilometers. Such branded certificate of
18 title shall contain the words "odometer originally set to kilometer measure."
19 Each branded certificate of title shall have its brand carried forward to all
20 subsequent certificates of title issued in this state.
21 (3) A seller shall provide written disclosure to a purchaser if a vehicle
22 for which the last ownership document was not issued by a U.S. jurisdiction
23 was originally manufactured with an odometer device which recorded distance
24 traveled in kilometers.
25 (4) A seller shall provide written disclosure to a purchaser if the
26 transferred vehicle has a title bearing the brand "odometer originally set to
27 kilometer measure."
28 (5) A purchaser who has received the written disclosure required pursuant
29 to subsection (3) or (4) of this section shall include a copy of such disclo-
30 sure with any application for certificate of title.
31 (6) The department may promulgate rules as necessary to implement the
32 provisions of this section.

Where motor vehicles are moved from another country into Idaho for
sale, with odometer readings in kilometers, they must obtain a branded
certificate of title from the Idaho Transportation Department. The
title shall reflect "odometer originally set to kilometer measure."
