|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 100 BY TRAIL 1 AN ACT 2 RELATING TO THE UNIFORM BUILDING CODE; AMENDING SECTION 39-4103, IDAHO CODE, 3 TO PROVIDE AN EXEMPTION FOR WINDOWS AND OPENINGS AROUND WINDOWS WHEN A 4 WINDOW OR WINDOWS ARE BEING REPAIRED OR REPLACED IN A STRUCTURE AND TO 5 PROVIDE AN EXCEPTION; AND DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 39-4103, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 39-4103. SCOPE -- EXEMPTIONS. This chapter authorizes the state division 10 of building safety and local governments to adopt and enforce building codes 11 pursuant to the provisions of this chapter. All buildings owned by any state 12 government agency or entity, or which are constructed or renovated specifi- 13 cally for use or occupancy by any such state agency or entity, shall conform 14 to the codes adopted in this chapter. The following is exempt from the provi- 15 sions of this chapter: 16 Equipment used primarily for industrial chemical process purposes and for 17 mineral extraction and mineral processing purposes. This exemption shall not 18 include the erection and fabrication of new boilers, pressure vessels and 19 other equipment as required to condition the building for personnel comfort 20 and safety. Equipment in this regard shall mean and shall be limited to facil- 21 ities or installations for heating, ventilating, air conditioning, 22 refrigerating equipment, elevators, dumbwaiters, escalators, and boilers and 23 pressure vessels associated with building heating systems. 24 Windows and openings around windows when windows are being repaired or 25 replaced in a structure. This exemption shall not include windows and open- 26 ings around windows in a newly constructed structure for which a building per- 27 mit is required. 28 SECTION 2. An emergency existing therefor, which emergency is hereby 29 declared to exist, this act shall be in full force and effect on and after its 30 passage and approval.
STATEMENT OF PURPOSE RS 12470 This legislation would amend Section 39-4103, Idaho Code to provide an exemption for windows and openings around windows when a window or windows are being repaired or replaced in a structure. The exemption shall not include windows and openings around windows in a newly constructed structure for which a building permit is required.
