|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 105 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE SEED ADVISORY BOARD; AMENDING SECTION 22-435, IDAHO 3 CODE, TO ADD THE PRESIDENT OF THE IDAHO SEED ANALYSTS ASSOCIATION AS A 4 PERMANENT MEMBER OF THE ADVISORY BOARD. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 22-435, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 22-435. STATE SEED ADVISORY BOARD. (1) In order to maintain close contact 9 between the department and the seed industry, there is hereby created a state 10 seed laboratory advisory board which shall consist of eight (8) official mem- 11 bers and eight (8) ex officio alternates appointed by the director of the 12 department of agriculture from a list provided by the Idaho seed council. The 13 Idaho seed council will nominate a member and an alternate for each vacancy on 14 the advisory board to represent the following seed commodities: 15 (a) Cereal grains 16 (b) Grasses - turf 17 (c) Grasses - forage 18 (d) Small seeded legumes 19 (e) Corn and small seeded vegetables 20 (f) Garden beans 21 (g) Field beans 22 (h) Oil crops. 23 The executive secretary of the Idaho crop improvement association shall serve 24 as a permanent ninth official member of the board. The president of the Idaho 25 seed analysts association, or his representative, shall serve as a permanent 26 tenth official member of the board. Additionally, without the need for any 27 nominations, the director shall appoint one (1) grower member who shall serve 28 as thetentheleventh official member of the board and serve a three (3) year 29 term. 30 (2) The members first appointed shall determine by lot the length of 31 their terms: Four (4) to serve for three (3) years, and four (4) to serve for 32 two (2) years, each term beginning July 1, 1989. A member and his alternate 33 shall serve the same length of term. Vacancies in office shall be filled by an 34 alternate for the unexpired term. 35 (3) Official members or an alternate present in the absence of his 36 respective representative will have the right to vote. A member and his 37 respective alternate are not to work for the same employer. 38 (4) Members or alternates of the board shall be compensated as provided 39 in section 59-509(a), Idaho Code. 40 (5) The functions of the board shall be to advise and counsel with the 41 department in the administration of the provisions of sections 22-414 through 42 22-436, Idaho Code. 43 (6) The board shall meet at the call of the chairman or the director of 2 1 the Idaho department of agriculture or his designee. A majority of the members 2 present at any meeting shall constitute a quorum, and a majority vote of the 3 quorum at any meeting shall constitute an official act of the board. 4 (7) At the first meeting after July 1, in each year, the board shall 5 select a chairman. The director of the Idaho department of agriculture and 6 the bureau chief of the Idaho state seed laboratory in the department of agri- 7 culture or their representatives, shall be ex officio members without the 8 right to vote.
STATEMENT OF PURPOSE RS 12328 Amend Title 22, Chapter 4, Section 22-435, Idaho Code, to add the Idaho Seed Analysts Association as a permanent member of the Advisory Board. The Idaho Seed Analysts Association member would add technical expertise and have the same voting privileges as other Board members. FISCAL IMPACT None. The Idaho Seed Analysts Association would cover all expenses associated with the meetings.
