  1                                        AN ACT
  2    RELATING TO THE DIVERSION OF LIVESTOCK AND  OTHER  ANIMALS;  AMENDING  SECTION
  3        25-221A, IDAHO CODE, TO PROHIBIT CERTAIN DIVERSIONS OF LIVESTOCK AND OTHER
  4        ANIMALS  ABSENT PRIOR NOTIFICATION TO AND APPROVAL BY THE DIVISION OF ANI-
  5        MAL INDUSTRIES; AND DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 25-221A, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        25-221A.  DIVERSION  OF  LIVESTOCK AND OTHER ANIMALS. It shall be unlawful
 10    to divert livestock or other animals from destinations consigned on a certifi-
 11    cate of veterinary inspection, other approved certificate  or  permit  without
 12    notifying  absent  notification  to,  and  approval  by,  the  division within
 13    seventy-two (72) hours following prior to the  diversion.  When  livestock  or
 14    other  animals  are  found not to be in compliance with the provisions of this
 15    chapter, the department of agriculture may order such livestock or other  ani-
 16    mals to be slaughtered, removed from the state, placed in an Idaho quarantined
 17    or approved feedlot or other approved facility.
                                                                        
 18        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 19    declared to exist, this act shall be in full force and effect on and after its
 20    passage and approval.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 12330
The purpose of this legislation is to require that the diversion
of all imported animals must be approved in advance by the
division of animal industries.  This change will increase the
division's ability to prevent the introduction or spread of
diseases.
                          FISCAL IMPACT
There is no fiscal impact to the General Fund.
