  1                                        AN ACT
  2    RELATING TO BRUCELLOSIS INDEMNITY PAYMENTS;  AMENDING  SECTION  25-606,  IDAHO
  3        CODE, TO AUTHORIZE THE BOARD OF EXAMINERS TO PAY OWNERS IN ACCORDANCE WITH
  4        DESIGNATED  STATUTORY  PROVISIONS  AFTER THE SALE AND SLAUGHTER OF CERTAIN
  5        ANIMALS AND TO STRIKE REFERENCE TO APPRAISALS AND REPORTS OF SALVAGE.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 25-606, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        25-606.  SALE  OF  REACTORS FOR SLAUGHTER -- PAYMENTS TO OWNERS. The owner
 10    of cattle or other animals which have shown a positive reaction to the brucel-
 11    losis test shall sell such reactors under the direction of the department at a
 12    public auction market for immediate slaughter at a public slaughtering  estab-
 13    lishment  where  federal or state post mortem inspection is maintained; or the
 14    department may authorize such slaughter upon the  owner's  property  or  other
 15    place  under  the  direction of said department. After such sale and slaughter
 16    the department board of examiners is authorized to pay such owner out of funds
 17    appropriated by the legislature for that purpose, an indemnity not  to  exceed
 18    twelve  dollars  and  fifty  cents  ($12.50) for any grade animal or more than
 19    twenty-five dollars ($25.00) for any purebred animal in accordance  with  sec-
 20    tion  25-614A, Idaho Code. No compensation shall be made until said owner com-
 21    plies with the rules and regulations of the department. Appraisals and reports
 22    of salvage are not required. Proof of destruction  is  required.  Post  mortem
 23    reports will be accepted as proof of slaughter.

Statement of Purpose / Fiscal Impact


                     STATEMENT OF PURPOSE

                             RS 12332

The purpose of this legislation is to reconcile conflicting
provisions regarding indemnity payments for livestock condemned and
destroyed due to brucellosis infection.







                         FISCAL IMPACT

The only fiscal impact to the General Fund would be in the event of
a brucellosis outbreak that was not covered by federal indemnity.
