  1                                        AN ACT
  2    RELATING TO OPEN PUBLIC MEETINGS; AMENDING SECTION  67-2341,  IDAHO  CODE,  TO
  3        PROVIDE  THAT  ANY 4-H CLUB THAT IS PART OF AN AGRICULTURAL EXTENSION PRO-
  4        GRAM OF A HIGHER EDUCATION INSTITUTION IN IDAHO IS  A  PUBLIC  AGENCY  FOR
  5        PURPOSES OF OPEN MEETING LAWS AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 67-2341, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        67-2341.  OPEN PUBLIC MEETINGS -- DEFINITIONS. As used in this act:
 10        (1)  "Decision" means any determination, action, vote or final disposition
 11    upon a motion, proposal, resolution, order, ordinance or measure  on  which  a
 12    vote  of  a  governing  body  is required, at any meeting at which a quorum is
 13    present, but shall not include those  ministerial  or  administrative  actions
 14    necessary to carry out a decision previously adopted in a meeting held in com-
 15    pliance with sections 67-2342 through 67-2346, Idaho Code.
 16        (2)  "Deliberation"  means the receipt or exchange of information or opin-
 17    ion relating to a decision, but shall not include informal or  impromptu  dis-
 18    cussions of a general nature which do not specifically relate to a matter then
 19    pending before the public agency for decision.
 20        (3)  "Executive  session" means any meeting or part of a meeting of a gov-
 21    erning body which is closed to any persons for deliberation  on  certain  mat-
 22    ters.
 23        (4)  "Public agency" means:
 24        (a)  aAny  state  board,  commission,  department,  authority, educational
 25        institution or other state agency which is created by or pursuant to stat-
 26        ute, other than courts and their agencies and divisions, and the  judicial
 27        council, and the district magistrates commission;
 28        (b)  aAny  regional  board, commission, department or authority created by
 29        or pursuant to statute;
 30        (c)  aAny county, city, school district, special district, or other munic-
 31        ipal corporation or political subdivision of the state of Idaho;
 32        (d)  aAny subagency of a public agency which is created by or pursuant  to
 33        statute, ordinance, or other legislative act;
 34        (e)  Any  4-H  club that is part of an agricultural extension program of a
 35        higher education institution in Idaho.
 36        (5)  "Governing body" means the members of any public  agency  which  con-
 37    sists  of two (2) or more members, with the authority to make decisions for or
 38    recommendations to a public agency regarding any matter.
 39        (6)  "Meeting" means the convening of a governing body of a public  agency
 40    to make a decision or to deliberate toward a decision on any matter.
 41        (a)  "rRegular  meeting" means the convening of a governing body of a pub-
 42        lic agency on the date fixed by law or rule, to conduct  the  business  of
 43        the agency.

  1        (b)  "sSpecial  meeting"  is a convening of the governing body of a public
  2        agency pursuant to a special call for the conduct of business as specified
  3        in the call.

The legislation relating to open public meetings amends Section 67-2341
of the Idaho Code. The legislation provides that any 4-H Club that is
part of an agricultural extension program of a higher education
institution in Idaho is a public agency for purposes of open meeting
laws.
