  1                                        AN ACT
  2    RELATING TO ANIMAL DISEASE CONTROL; AMENDING CHAPTER 2, TITLE 25, IDAHO  CODE,
  3        BY  THE  ADDITION  OF  A NEW SECTION 25-207A, IDAHO CODE, TO AUTHORIZE THE
  4        DIVISION OF ANIMAL INDUSTRIES TO PROMULGATE RULES FOR THE  REGULATION  AND
  5        PROHIBITION  OF CERTAIN PRIVATE FEEDING OF BIG GAME ANIMALS WITH THE COOP-
  6        ERATION OF THE DEPARTMENT OF FISH AND GAME.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Chapter 2, Title 25, Idaho Code,  be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 25-207A, Idaho Code, and to read as follows:
                                                                        
 11        25-207A.  PRIVATE FEEDING OF BIG GAME ANIMALS -- RULES  FOR  DISEASE  CON-
 12    TROL. (1) In order to provide for disease control and the protection of health
 13    and  human  safety, the division of animal industries is authorized to promul-
 14    gate rules for the regulation and prohibition of the private  feeding  of  big
 15    game animals.
 16        (2)  The  division shall cooperate with the department of fish and game in
 17    the designation of such areas and  the  promulgation  of  rules  necessary  to
 18    facilitate such regulation.
 19        (3)  Rulemaking authority pursuant to the provisions of this section shall
 20    only  apply to regulate or prohibit persons who purposely or knowingly provide
 21    supplemental feed to big game animals in a manner that results in  an  artifi-
 22    cial  concentration  of  such  animals  that may potentially contribute to the
 23    transmission of disease.
 24        (4)  Rulemaking authority pursuant to the provisions of this section shall
 25    not apply to supplemental feeding activities conducted by  the  department  of
 26    fish and game.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 12633
The purpose of this legislation is to provide for the regulation
of the private feeding of big game animals in areas of the state
where issues of disease transmission among big game animals, and
from big game animals to livestock are a concern.  Rules to
regulate private feeding shall be made in cooperation with the
Department of Fish and Game.  This legislation does not apply to
supplemental feeding activities conducted by the Department of
Fish and Game.
                          FISCAL IMPACT
There is no fiscal impact to the General Fund.
