1 AN ACT
2 RELATING TO CONSOLIDATION OF LIBRARIES; AMENDING SECTION 33-2710, IDAHO CODE,
3 TO CLARIFY THE BUDGETS TO BE USED TO DETERMINE A CONSOLIDATED DISTRICT'S
4 FIRST BUDGET.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 33-2710, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 33-2710. DETERMINATION OF THE PROPERTY PORTION OF THE BUDGET FOR CONSOLI-
9 DATED LIBRARIES -- DISTRICT AND DISTRICT -- DISTRICT AND CITY. (1) When two
10 (2) district libraries have agreed to consolidate, the property tax portion of
11 the new consolidated district's first budget will be determined in the follow-
12 ing manner.
13 The property tax portion of each district's most recent annual certified
14 budget will be added together. The resulting figure will be considered the
15 dollar amount of property taxes on which to base the first annual budget for
16 the new consolidated district. The provisions of section 63-802, Idaho Code,
17 shall be applied to this dollar amount.
18 (2) When a tax supported city library has voted to consolidate with a
19 district library, the property tax portion of the new consolidated district's
20 first annual budget will be determined in the following manner.
21 The city library budget figure will be defined as the budget for library
22 services, whether from the general fund and/or the library fund, in the city's
23 most recent annual certified budget in effect on the date the election was
24 held, less fines, fees, and any other identifiable revenues from nontax
25 sources, and any grants made directly to the city library board. The city
26 library budget figure and will be added to the property tax portion of the
27 public library district's most recent annual certified budget will be added
28 together in effect on the date the election was held. The resulting figure
29 will be considered the dollar amount of property taxes on which to base the
30 first annual budget for the new consolidated district. The provisions of sec-
31 tion 63-802, Idaho Code, shall be applied to this dollar amount.
32 If the city has established a dedicated library fund in the year in which
33 consolidation was approved in effect on the date the election was held, those
34 dollars will be removed from the city budget in the fiscal year in which the
35 newly consolidated district begins to levy to provide library services.
36 (3) In any consolidation, the dollar amount of property taxes for the new
37 consolidated district's budget shall not exceed six hundredths percent (.06%)
38 of the market value for assessment purposes of all taxable property within the
39 district.
40 (4) In any consolidation, the existing bonded debt of any district or
41 districts shall not become the obligation of the proposed consolidated library
42 district. The debt shall remain an obligation of the property which incurred
43 the indebtedness.
STATEMENT OF PURPOSE
RS 12715
If city residents vote affirmatively to join a library district
this proposal clarifies that the city library budget in effect on
the date of the election is the budget to be used to determine a
total district budget and then calculate the first annual
assessment rate.
FISCAL IMPACT
Fiscal effect would vary from district to district depending upon
the size of the city library budget and the rate of the district
assessment. This information is required to be presented to
voters prior to any consolidation election.
